i have not seen my wife since about 3 years will that affect badly on my CR1 interview.

because my wife do not have enough money to buy the ticket...

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

CR-1? your timelines show K3 Proof of having met in past two years? Why did the embassy returned the petition to USCIS? Interview Date : 2008-01-22?

CR-1? your timelines show K3 Proof of having met in past two years? Why did the embassy returned the petition to USCIS?

they returned the petition for further review and last week i got the following email from the USCIS :

On October 26, 2009, your document I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was processed and mailed to the address on record. If you have not received it within 30 days of October 26, 2009, contact our customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283

This step applies to applications that result in an applicant receiving a card (such as a green card) or other document (such as a naturalization certificate, refugee travel documents or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

the USCIS officer told my wife congragulations that we will be togethor soon and i will be notified by the embassy about the date that i will go there and swear to get the visa.

but honestly i m worried because i have not seen my wife since 3 years

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

The K3 is still on AP, but the approved I-130 has been moved to the consulate.

the interview will be for the CR1 this time and not for the K3.

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

Yes, not seeing your wife in three years will be a negative factor in evaluating whether the relationship is bona fide. Whether you'll be able to overcome it will depend on things we don't know about your case. This is only one factor among many but not a small factor.

USCIS doesn't do the evaluation of a bona fide relationship in Visa cases. The Consular officer does that. I wouldn't expect success without another visit. All you can do is what you can do but that doesn't mean it will be enough.

What results is YOUR WIFE GETTING when she calls the DOS hotline?

I suggest that you engage her to CALL DOS, get a human, inquire, then report back here with the results - we MIGHT have some OTHER opinions for you, based on the RESULTS of yer wife's phone call.

I'm not knocking ya, but the DOS CALL CENTER knows all - it's on your head to find out what they know. Engage your wife to make the call, find out.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I hadn't seen my husband for a mere 10 months because I didn't have the money to fly down there. We ended up having a fraud interview that I had to attend. I would recommend attending the interview.

beg, borrow, BUT DON'T steal.

Definitely attend interview.

I think they require that you've seen each other within two years at least once.

I'm sorry. It's tough but you and your wife must do everything possible to see each other before the interview.
