Just got the finace visa Yeah!! now it said to apply for I130?

Timeline

My fiance just received a his visa in the mail on friday I'm so happy and it only took us 5 months. Thank you so much VISA JOURNEY COMMUNITY :o)

But now I have a question about the next step. There was a letter that came with the visa and said something about we have to apply for I 130 and than 485 is that right? I am so confuse. I didnt know that I have to apply for I 130.

Timeline

Once you get to the states and get married you will file for the I-485 (AoS) and you can apply for the I-131 (Advanced Parol) and I-765 (Employment Authorization Document). You don't have to apply for the I-130 as thats the petition for a visa for someone who is married, and you will already be in the states on your K1 and can adjust from that.

Once you get to the states and get married you will file for the I-145 (AoS) and you can apply for the I-131 (Advanced Parol) and I-765 (Employment Authorization Document). You don't have to apply for the I-130 as thats the petition for a visa for someone who is married, and you will already be in the states on your K1 and can adjust from that.

That is what I thought too. He just read me the letter and it said:

"Once you are married, your US citizen spouse will need to file I 130 form and you must also file from I 485 AOS"

So, I'm not sure to follow the direction or go by the Visa Journey guideline.

For the K-1 AOS you do not need the I-130. Either the consulate letter is wrong or you have mis-read it and they mention the I-131 which is an advance travel document which you have the option of including in your AOS filing.

The letter is wrong. Don't worry about it. No I-130 is needed. (unless you do not get married within 90 days)

The department of State, that issues visas, does not handle AOS, that is done by USCIS. The DOS is confused...not you. They are commenting on things that are not their concern or department and have made an error.
