Is getting an Individual Taxpayer Identification Number for a foreign spouse necessary?

Hello everyone. Thought I'ld throw this question in to you guys already living in the USA.

My husband, who is a LPR says for his tax purposes he files as single since i am not physically present in the States with him. I just want to ask if that's what the rest of you are doing. If that isn't how you are filing, what do u think? When I brought this up, he researched and came up with the idea of me getting an Individual Taxpayers Identification Number (ITIN).

Please reply me with as much info as you can. Thanks in advance.

2006-12-23: I-130 Sent

2007-01-05: I-130 NOA1

2009-05-21: I-130 Approved

2009-06-04: NVC Case No. generated

2010-01-15: DS-3032 / I-864 Bill generated

2010-01-17: Choice of Agent sent via e-mail

2010-01-22: Paid I-864 Bill

2010-01-25: I-864 Bill shows PAID

2010-01-28: Received email saying: Choice of agent accepted/IV bill generated.

2010-01-28: Paid IV bill.

2010-02-25: Sent out completed I-864 and DS- 230.

2010-04-08: Case Complete.

2010-05-03: Interview scheduled for June 2nd 2010 as per NVC live operator.

2010-06-02: 221g refusal pending return of requested document.

2010-06-03: Obtained the requested document. E-mailed consulate requesting a new interview date.

2011-01-26: Visas Approved! To be picked up Feb 2nd.

2011-02-01: Got an e-mail stating Visas aint ready for pick-up yet!! Oh God PLSSSSSSS.

2011-02-09: Got a reply to my incenssant e-mails scolding me for writing, and asking me to refrain from writing more letters, and stating officially that am on AP!!!

2011-03-15: Picked up Visas. Oh My God!

2011-03-21: POE, Atlanta Georgia. Find it hard to believe this is truly happening. Thank you God.

NOW IN THE US.

2011-03-28: Received our Social Security Cards in the Mail.

2011-04-08: Received Green Cards.

I don't think he can file a tax return as a single because you are married.

He can file it as either married separately or married jointly.

If he chooses to file jointly, he needs to get your ITIN.

He can file it as either married separately or married jointly.

If he chooses to file jointly, he needs to get your ITIN.

I agree. He cannot file as single. He either files married separately or married jointly with you having to get a ITIN.

He would probably pay less tax as married filing jointly. However, any income that you would have could be taxed as well. You would most likely get a foreign tax credit for any taxes you would pay in your home country on your joint US tax return. You could calculate your taxes both ways to see which is more advantageous.

I hope I am not going to confuse myself the more .At present, I am not working.So if we do married filing jointly,I have no income taxable.My husband said, ''he read somewhere'' that if your spouse is outside US and you are living alone in US as married,you can elect to claim single in your tax return. This is really misleading as we ve obviously married.You can direct me to any link that u think had addressed this issue better.

What you or husband needs to is go to the IRS website and find Publication 17 to begin with...

Just to reinforce what's already been said, a legally married taxpayer cannot file as single, regardless of where the spouse lives.

There were some other issues, but this case involves a couple who had been married, but started living separately, and had some legal arrangement that might have even been considered a legal separation. The IRS said that, because they were legally married, they had to file as married and could not choose to file as single. The court upheld that decision.

When a taxpayer signs a return saying he's a single person, he's swearing to the US Government under penalty of perjury that he is not married. That statement may make it difficult to try and convince a different branch of the US Government that this allegedly single person is in a bona fide marriage for the purpose of obtaining a visa.

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
