Hi,

I have a few questions about bringing my mother and my brother (12 years old) from Vietnam to the US. I understand that i have to file i 130 to bring my mother to here first; and once my mother comes here, she can file another I130 for my brother.

My questions are:

1. After my mother comes here, when is she eligible to file I130 for my brother?

2. If she doesnt have any income, can i be the co-sponsor?

2. How long does it take for the process after she files for my brother?

That will depend on the figures then applicable, c $25,000 probably

Is she wants to retain her residency status, yes she will be living in the US. She can take trips of course.

Btw, do you have any idea how much income i need to be the joint sponsor for my brother? (given that i am married and i sponsor my mother) Look at Form I-864P. The instructions will give you the guidelines for how much you will need to earn to be a good joint sponsor. You will need to include yourself, your spouse, children, and anyone else you may have filed an I-864 for in the past. For 4 people (you, spouse, mom, and brother), you will need to earn $25,000/year. This is for 2009. The numbers will change in future years.

and also during that 4-5 years, does my mom need to stay in the US? Yes, your mother will need to reside in the US. If she leaves the US for more than 6 months, she could be viewed to have abandoned her green card (LPR) status. If she does not have a green card at anytime during the petition for your brother, the petition is automatically withdrawn. She cannot live in Vietnam with a US green card and petition for your brother. Her green card will be considered abandoned. With a green card, she can visit Vietnam. She cannot be outside the US more than she is inside the US.

As a US citizen, you can petition for your brother. It will take about 11-12 years. It might be the better alternative if there is an issue with separating your mother and brother.
