So-AOS time it is. Preliminaries:

- How long do we/can we wait to file for this?

- I know I can apply for a Social Security # with this-can I apply for one beforehand?

- Allowance to leave the country-I ask for this at the same time as sending my AOS stuff, right?

We have a tonne of insane stuff going on in the next month-new vehicle, new place to live, blah blah... hence the questions re: the timing of sending this stuff in.

Congrats on the wedding!!

Its smart to file AOS before your I-94 expires. That way you aren't stuck in the US without any prof of status.

You can apply for an SSN with your passport and I-94, as long as it is still valid. You don't need to file for AOS first.

When you apply for AOS you can also apply for Advance Parole (I-131) along with your EAD (I-765) at the same time for an inclusive fee of $1010.

I don't mean to rain on your parade but if you married less than 90 after you entered the US you might get a bit of hassle by USCIS. You entered the US and to avoid leaving you got hitched, utter BS but that's the way they think. I assume that you entered the US as a visitor (technically B2) and not on any form of visa. The rule is 30 days or less expect to be hassled, 30-60 still likely but maybe not, 60-90 even less likely, 90 or more don't expect to be hassled.

According to her timeline she came in on a K-1. In which case, its a very good thing you married within the 90 days! ;)

Shouldn't be a problem (knock on wood!!!) if her passport expires more than 6 mos. from the date of entry. Even with a K-1 visa the 30-60-90 day rule has been used (makes no sense to me either), though thankfully not often.

This is soooooooooooooooooooooo wrong, why to assume this? One simple click could have shown you some relevant facts. Sheesh !!

M613 - There's a 'dead window' on the end of the I-94 POE date, where if you apply for a SSN it'll get denied. I think it's 12 days prior to I-94 expiration? but i could be wrong.

As soon as you get the marriage license, take it, yer passport, and file for the SSC - it'll get issued in your married name. If you don't care one way or the other about having your married name on the SSC, go to the SSA on Monday and apply.

There's no hard/fast rule for WHEN to file the AOS package - most assume (wrongly ) that it must be done before the I-94 expires, 90 days from POE date. I'd suggest 6 months past the date of marriage is getting a bit 'long in the tooth' - and try, for at least one month after ya get the official marriage license.

PS - Since yer moving, suggest you file AOS right after you get the new address .. Life is SUCH LESS HASSLE when the address is current.

If they try to bring it up with me, I would not hesitate to say that I couldn't be unemployed for longer than completely necessary, so we wanted to get the paperwork filed asap. If they question that, then there's seriously some problems with the system (like we didn't know there was already...). Entrance on a K-1 Visa implies an EXPECTATION and INTENTION to "get hitched" (we even have to both sign letters to prove we intend to get married within 90 days)... in this case it's not just something done to 'avoid leaving'.

Calm doooooooooooooooooooooown, Darnell, I'm not the enemy. I didn't say it made any sense to me. It is a rule that is SUPPOSED to apply to visitor and tourist visas not the K-1. I was in Spokane, WA when not one but two couples were dealing with this very situation so whether or not it should have happened is not the point. Ask anyone how well some members of the USCIS know their own rules, go read what Mikey78 posted the other day if you want to click on something, Darnell. M613, I didn't mean to alarm you.

I'mma have somethin' to say to them if they try to create an issue about getting married "too soon".

Now that's the spirit!!!! :thumbs::lol: Out of the two couples there that day, one was very quiet and one was not. The USC (husband) of couple #2 (why do I suddenly sound like Bob Eubanks on the Newlywed Game :lol: ) was fuming (do you blame him?), we concluded our business (Mom had to swear out a FOIA request) before he was called up to the window but the situation got real ugly. I believe they called in extra security, because there were four security guards there when we left. :wow:
