Bobby K1> New Delhi Embassy - Interview Visit by Petitioner

In Bobby's post it was asked about how the consulate would know if the petitioner was there for the interview. I already know that without a doubt I can't go to the interview. I don't have the time off of work and I can't leave my kids behind or afford to take them. Not that Delhi is a good place for them or should they be dragged to the interview with me (and of course there is no way I would leave them in the motel....not even close to being an option). In the letters I am writing to go to the interview (my how we met letter, explanation of taxes, etc.) I have included a statement about why I am unable to be at the interview (due to family obligations as I stated it). Is that a good idea? Is there a good way to word that explanation? How could I help him from here when he is there alone?

I don't think we will have any problem proving a bona fide relationship. We both send each other gifts like crazy and I have photo evidence and call logs (70+ pages) and emails, etc. Do any of you who have been through your interview where the petitioner wasn't there have any insight or recommendations for things that might help boost the evidence at the interview?

I've been researching the site and both of us have been preparing for the interview. Not rehearsing because for goodness sakes that would be a red flag but basically just continuing to talk to each other about everything they could be asking about such as my family and his family and life and circumstances. I just want to make sure we don't wind up on AP or getting denied for some little thing. I don't set out to fail and maybe I plan and prepare a little too much but this is the most important thing in my life, I couldn't live with myself if I didn't give it 10,000%!

January 2009 - K-1 Denied by the consulate

January 2011 - Moved to India - Yikes!

October 2011 - DCF filing rejected by overzealous employee at the embassy

December 2011 - Tourist visa denied (not surprising)

March 2012 - CR1/IR1 process started

May 1, 2012 - RFE and some of our information was entered into the computer wrong by the CSC

I just wrote the embassy an email before the interview. Here's what it said:

Since I'm unable to be there for my fiance's interview and the embassy doesn't allow interested parties to attend the interview due to security reason's, as it says on their website, I would request if possible, for the embassy to contact me by phone if they have any questions at anytime, day or night, no matter what time it is here in the states. Or if it is more convenient and the Embassy would rather that I call them at time of interview, I will be happy to do so. They only need to give me the exact time and number to call.

I know that even though it really does state the above in the Embassy's website, I 'could' have went with him if I were financially able to go, but wanted to use their own written rule to my advantage by having them believe that this was one of the primary reasons I wouldn't be there, yet still giving them the option of contacting me if they chose to do so.

July 10, 2009- NVC sent Reaffirmed petition back to U.S.Embassy, New Delhi.

August 10, 2009- Embassy notified via email that they've received the Re-affirmed petition assigned with a 'new' case number as well as mailed Packet 3.

August 20, 2009- Embassy sent as an email attachment, the DS-230, Applicants Statement and Cover letter to Packet 3.

August 20, 2009- Mailed and Emailed request letter to Embassy to extend validity date of petition.

August 25, 2009 - Embassy received request to extend validity letter.

Sept 2, 2009- Embassy confirmed their receipt of the completed DS-230 and Applicants Statement.

October 29, 2009- 2nd Interview date- Visa Approved!

November 4th, 2009- Received Passport with Visa intact!

December 4th, 2009- Fiance arrived in U.S. - MARRIED Dec. 7th!

February 23rd-Mailed AOS Packet

March 3rd, 2010-Check Cashed

March 6th, 2010-Received AOS Receipt Notice

March 29th, 2010-Biometrics

Sept. 14, 2010-GC Interview -Approved!

No, They did not contact me. I really didn't think they would either, just wanted to make sure they knew it was an option and that I was willing.

No, They did not contact me. I really didn't think they would either, just wanted to make sure they knew it was an option and that I was willing.

If you read that post I created (http://www.visajourney.com/forums/index.php?showtopic=224976) it appears that more than one member of this forum was able to attend the interview. It appears both posters were tied to the New Delhi consulate - so it appears that you are indeed able to enter the embassy with your fiance and even attend the interview (at the discretion of the CO).

CR-1 Visa Was Approved :-)

Thanks Bobby, I did read your post. What I meant in mine is I know I can't be there because of family obligations. I can't get the time off of work or the time away from my kids in the middle of the school year to go. I would be at that Embassy in a heartbeat if I were single and had vacation time. I don't, I spent all my vacation time being sick and packing and such. Things that were all unavoidable. I am not being prevented from going to the interview, I just am not able to go. I'm just trying to do everything possible to let the embassy know this relationship is bona fide.
