I got NOA 2 in july for both I-129 and I-130.

In August I paid $470 fee to the NVC. I got NVC letter to send them $470.

In september I filed DS230 for my wife.

After that NVC asked me to send couple of things and I-864 which I sent back earlier this month.

Now my lawyer didn't say anything what she got in the mail from the NVC. I requested to call me and let me know what is going on. She didn't bother to call or email to me to explain things to me. I'm bit frustrated here so I thought I might ask on this forum and find out what is going on with my K3 visa processing.

Any help will be greatly appreciated here

I'm very confused right now. I thought DS230 and I-864 required for IR1/I-130 processing not for K3 processing. My lawyer and her assistant kept telling me that both required for K3 processing. I wanted to go with the K3 and thats why I paid $470 and send them DS230 and I-864. I kept questioning them about that. I hired lawyer so I won't make any mistake and it seems like my lawyer is screwing me or something.

I did some research and it seems like im going for IR1/I-130 not K3...because I filed DS230 and I-864....is that right?

Today she told me that I need to file k3 petition again. I don't get that. Please help me to understand the K3 and IR1 processing so I can tell her what to do on this Tuesday when I meet her.

Please tell me what is my best option right now. Can I still go for either one or just IR1/I-130? I don't want to file my petition again. I'm missing her very much and to be away from her few more months is not something i want at this point.

The I-864 and DS-230 are for the I-130 petition.

You KNOW the NVC Casenumber for the I-130, but - do you know the NVC Casenumber for the K-3?

I suggest calling NVC , and at least GETTING the K-3 NVC casenumber.

Ask NVC if it's left NVC . If it's not left NVC - ask them if it's still undergoing namechecks.

If it's LEFT NVC - Then - call DOS hotline, inquire about the case with the NVC casenumber .

ASK FOR STATUS - but be diligent:

1. ask for current status, with the date/time stamp of when it flipped to 'that status' and

2. ask for the prior 3 status changes, again with the date/time stamp .

Lawyers can be useful, but if ya follow the guides here at VJ - you can handle all of these petitions at DIY (IMO ).

FWIW, it may be that NVC and DOS won't talk to YOU - if there's a G-28 in place from the attorney.

Now, on to the I-130...

It's been a month since the DS-3032 wes sent it, right? Find out the case status on the I-130 - it may be FINISHED UP already.

As to why the attorney is asking you to file another K-3 - wei - #######? TO ME - this means something got messed up with the lawyer, at the lawyer's office. Get the statuses on the 2 petitions at NVC - call the hotline, get a human.

I just found from my wife that she got an email from NVC and she will have an CR-1 interview on Dec 16. I feel much better now.

But - I gotta ask you - why not call NVC and DOS hotlines? YOU CAN DO IT YOURSELF !!

I think your lawyer did you a favor by going for the CR-1 visa and not the K-3. K-3 is not obsolete anymore - it takes almost as long as CR-1, costs much more than CR-1, and does not have the benefits of CR-1 like immediate work permit once entering US. Read the guides on VJ, and please, do update your VJ timeline. Good luck at your wife's interview - that'd be the nicest Xmas present for you :thumbs:

Thanks guys.

I think Lawyer is wrong here. She was kept telling me that we are going for the K3 while she asked me to pay $470 to NVC. I told her it means we are going for the I-130 and not K3 but she and her assistant kept saying it is part of the K3 processing.

I wanted to go for the K3 before because I didn't have the job and i thought I will need affidavit of support during the interview time. Anyway I found the job earlier this month and sent them affidavit of support based on my new job. Everything is fine now im just disappointed that my lawyer didn't give me the right advice.
