Hi Everyone,

Quick question on I-864EZ. I have petitioned for my parents and am in the process of completing the AOS forms. I am married, however, my income alone will qualify for the AOS. The thing is that we file our tax returns together. I'm sure NVC can take a look at the W2 and figure out my income.

Question 19: asks for total gross income from 1040EZ....I do not file 1040EZ and cannot even take the income out of the tax return since it's a combination of mine and my wife's.

Should I:

1. Cross out the 1040EZ line on the application and handwrite see W2 and use that income?

2. Use the regular I-864 and I-864A for my wife?

Any guidance would be helpful.

Use form I-854, your wife does not need to complete I-864 if your income is enough to meet the requirements. On the form where it asks for your income put the total amount as shown on your W2's do not include your wifes income.

You will need to include tax transcripts along with the I-864. If you plan to send a copy of your actual tax return you will need to include all W2's and schedules as well as the actual return.

I will then use the I-864 instead of I-864EZ and include our tax return copies with my W2 and other schedules. I don't think I have them all signed but I don't think that matters...right?
