Hello All,

Curious question regarding the use of my wife's maiden name or married name. I just got married in Colombia and I have yet to send out the i-130. Once I start the application I know we will use her maiden last name and paternal last name. My question is when does she make it official to use her married name? I don't think there is no where on the I-130 to indicate her married name. please help

CHILLTOWN_JC,

Your wife "makes it official" to use her married name whenever and wherever she starts using it. The I-130 is as good a place as any and better than most - why do you seem to think otherwise?

Yodrak, I was just confused on where to start. I did not want to hold up the application with any disparencies. So I would use her married name under on the I-130 section c. question #1 under Name (family name in CAPS)?

She can use the married name in the marriage certificate and subsequently in all documents except her birth certificate.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Usually the wife's married name is husband's last name. Make sure, your marriage certificate reflects her married name as her last name. After our marriage, my wife used her married name (my last name) in the marriage certificate and we are using it in all paperwork except for her birth certificate. A birth certificate mentions her name at the time of her birth.

example...

My married name was used on the I-130 that my husband submitted as well as the G-325A. My married name was also used on all forms with NVC including the DS-230 (application for the visa). I also had my passport changed to reflect same. My visa was then issued in my married name. This was all done as I wished to be known as such.

Hope this helps

CHILLTOWN_JC,

That's what I did.

What are "disparencies" and why would you be worried about them?

Chilltown,

Yes. Please have your wife change her passport with the married name, if it is not done so. Yes, her last name would be her married name (your last name too). Example: John Doe and Jane Doe. Here Jane is using her married name as her last name. Wife's Married Name = Husband's Last Name = Wife's New Last Name. Hope I am making sense. So use the married name in all documents (I-130, G-325A, I-864, DS 3032, DS 230) except for her birth certificate.
