K1 visa revoked, but...

Ok...so here's another chapter...

On October 30 my fiancee called the congressman's office and spoke to his assistant. She was very nice and told my fiancee that she'd help us and email the U.S. consulate (or embassy...don't really know how to call it...) here in Brazil on that same day.

She did and said that what happened was obviously a misunderstanding and that our relationship is real and she'd be glad if they could do something about it. And then the consulate response was different than just the usual "the consul is analysing the case" answer that both my fiancee and our lawyer got from them before. This time they said that she (congressman's assistant) had no reason to worry because they'd cooperate and act under the immigration laws. This response came from them last week and the congressman's assistant sent another email the day she got this one this time asking them to let us send any proof they want to show them that we're for real. So this week they emailed me and my fiancee asking us to send copies of all the emails we sent to each other since the begining of our relationship to the present day and all of our pictures together. So today we sent a package but not only with emails and photos but also with scans of cards (birthday ones, Christmas ones...) notarized letters from her parents and her sister, scans of phone bills since 2006, wedding plans...all that.

So anyway...now I don't know what's gonna happen. More waiting, I guess...hope it won't be a long waiting! Is there's anyone here who ever went through this or even heard about anyone going through something similar and ended up getting the visa? Are they going to call me for another interview or something?

Anyone ever went through the same thing and got the visa in the end or know someone who went through this and had a happy ending?
First, congratulations on the progress and the consulate's receptivity, si man!

If you go to the Latin American subforum and look for the "U.S. Consulate in Guayaquil, Ecuador" thread, you'll see some horror stories, but most of them worked out. There, we USCs were ordered to appear for a second interview, which the consulate called a "marriage interview," but it was really a Stokes interrogation. To make a long story short, your situation sounds FAR better: the consulate is not ordering both of you to appear, and they're responding receptively to the Congressional aide. If I were you, I'd be extremely hopeful, si man. :thumbs:

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Wow...thanks for the replies! Good to know that my situation doesn't look so bad! The evidence was sent already...there was over 1000 pages with evidences.

So it is possible to get the visa when stuff like this happens? I tried to find posts of people who algo had their visa sent back to USCIS to be revoked but got the visa in the end but I couldn't find. Do you think they'll really call me for another interview?

AP can take several months Rodrigo, just hang in there. I am thinking the age difference might have raised a red flag for them, and if you were too rehearsed (some people seem that way when they are nervous), stiff or even got snappy at your answers once they were grilling (being brazilian I know how we can be) they might have gotten upset with you or thought you weren't truthful.

The reality is these consuls pick some people to grill sometimes, it happens. You just have to hang in there.

I have good and bad experiences with the consulate in Rio, had a student visa at age 16 that was a breeze to get; had a tourist visa in 2004 (to visit my husband, then boyfriend) that was a pain, I was grilled, they called my house and asked my mother if I was gonna go work in the US, I was mistreated at the consulate and in the end they approved me for a 3 month visitor visa only, with an annotation of where I was going to and I could not go to any other city in the US; and then with my fiance visa the consul I got was wonderful to me, we chatted like old friends, she was glad I spoke English and loved the story of how we met and the plans we had for our future together, I couldn't believe I was treated so well after such a crappy experience 2 years earlier.

So in the end, it depends on the day, the consulate, and in your attitude, as they're watching you while you wait.

Good luck getting approved and know it can take several months.

Thanks for the replies Sebas&Lily, Moonandstar and Ladylethal!

I don't think I have enough energy to wait for several months and I know my fiancee feels the same way so we might just live here in Brazil. We're just tired of having strangers making important decisions in our lives and pretty much calling us liars, ya know? Not just us, but actually our family and friends too. I do believe that the age difference might be an issue for them since we're talking about someone who can't even say "good morning" to another human being so I think it was an issue for them. And yeah, I was definitely nervous, but mostly because I knew there would be strangers deciding about our future and I can't say I'm comfortable with that and another thing is that from the first minute I spent in that place, they made the whole thing look like a job interview, not a chat about my relationship.

What I can't understand is that my fiancee and I are together for over 3 years so what do they think we're doing? Do they think it's a big conspiracy involving everybody we know to bring me to the U.S. so I can go to Disneyland? I just wish they could understand that I don't need the U.S. to have a life or to be sucessfull...I got the brain, the heart and everything I need to be sucessfull here and I have a really good life actually...and I'm definitely not a person who's affected by Hollywood or anything that can gives an idea to a foreigner that the U.S. is some kind of paradise that it's all fun and great! The only reason I want to live there is so the girl I love and will marry someday doesn't have to be far away from her family and doesn't have to quit a job that she loves and be away from a life that she's used to, especially because she doesn't speak portuguese and that would make things really hard for her here, cause other than that...I wouldn't even try to visit the U.S.

Well...I just hope the best come out of this. One thing is for sure: They can't and will never break us up.

hello rodrigo seems like u have the same case as me the interviewer sent my forms & my medical exams back to USA & say that my relationship with my fiancee is fake & he had refused to see proofs even if i have the right to show'em to him any way im lost

there is a green paper on my passport but nothng written on it

That's exactly what happened, mourad2009...and I got a green paper too, it's checked on "others" and with the word "revocation" writen. But he never did send the case back to the U.S. cause right after what happened at my interview my fiancee sent them a letter she wrote on an email asking them to review the case and our lawyers did the same thing so they agreed to do this. It was almost a month later and we didn't hear any answer, so we contacted the congressman's office and his assistent helped us a lot! They emailed the U.S.consulate here in Brazil explaining the situation and asking them to review the case so they agreed to review the case and asked for evidences such as photos and emails (evidences that he didn't ansked to see at the interview...funny, ahn?) But it's been like 2 months and so far, and we got no answer from them.

Did you talk to an immigration lawyer or something? Sorry that the same thing happened to you! Trust me...I know how it is to have a complete stranger pretty much saying in your face that you're a liar and I'm deeply sorry to what happened to you!
