I-134

Ok, my situation is a little different. I just returned from visiting my g/f for the 1st time which I met on the internet in January. She lives in the Philippines. We want to get married but I am on unemployment since July. I am only planning on living in my state until I can sell my house then want to move to another state or maybe out of the US eventually. I really prefer not to work unless I find a very good paying job here. My last job paid me $73,000 ytd as of July. I receive $770 per month non taxed VA income. I receive $1500 from unemployment which I understand I cannot use to qualify. The market value of my stocks now are only about $38,000. My question is, do I have to show W-2's for my income this year or can I use tax statements for the past 3 years to satisfy the consulate? What will I show as far as current job on the G-325 & also on the I-134. Also, my visa probably will not go through until 2010. My g/f is a nurse & wants to work here asap. She has no problem with me staying home for awhile until we decide where we will live. I don't mind working but don't want to accept a low paying job. Can we pass the k-1 process using my 2007-2009 tax statements & what do I list as current jobs?

Probably not, as you need to state a current income and source. Stating last year's income or this YTD from a job you don't have would be a material misrepresentation. You may well be able to qualify based on assets plus your VA income. It depends on the details.

I won't be able to have co-sponsor as Manila frowns on that but also will not have one. Also, we took lots of pictures, plane tickets together to her town, 3 different hotel stays in both names. I just want to know if tax statements will suffice as far as income & what to list as jobs.

No, they want to see current income. The past years transcripts just justify to then that you have a steady job. You should most likely find a job that will pay above the minimum and go from there.

No, your tax statements don't reflect your currently derived income. You are unemployed. When asked about employment, your answer would be, "unemployed". What part of telling the truth do you not understand? Have you even looked at the I-134?

This is not a "poverty screening". The Consular officer will be making a determination whether your fiancee is likely to become a public charge. You may be able to qualify with a combination of your assets and your permanent income. A dollar in income shortfall can be replaced by three dollars in liquid assets.

Ok, thank you. Does anyone know if the Manila office accepts assets as income, I've heard some do not. I don't want to lose my unemployment & only plan on staying here to sell my house. After I move I will go back to work when I get a decent paying job, just not here.

Yes, they accept three dollars worth of assets to replace one dollar in income shortfall but I said "liquid assets". Until you "sell" your house your house isn't a liquid asset.
