Currently i'm living with my son who is 9years old in albany, NY. My first wife (his mom) died when he was 4years old. I got married last year. Since I was in Green card, I didn't applied for I130 for my wife. After my status changed to US citizen I applied for her I130 and I129F. My son spent 3 months with her in the summer vacation. He liked her very much and both had a very good time in India. After coming back to USA, he feels very lonely and he misses her a lot and he is not able to sleep well. Keep on asking me, why getting visa is taking so long and why I have to suffer. He is asking so many things about the Visa. And he asked is there any way to expedite this process. I said NO. But he is keep on telling me that there will be some way to expedite this process. He is still not sleeping well in the night and getting up in the mid night and looking for her.

Is there any way to Expedite this process? Pls. help me on this regard.

I can show this site and tell him that ...here is the process and how many of them are waiting... But still don't know how to convince him..

As his father you need to instill confidence in him, and be confident in the information you provide to him. It doesn't sound to me like you are being definitive enough.

Just explain to him, that everyone who is in the visa process is missing their loved ones. Everyone has to wait inline for their turn and that there is no way to expedite it....because you know there isn't... right? It is hard to get an expedite and the only ones I have seen offered are to those who are in active in the military.

Time to be brutally truthful with him.....and by the sounds of it....to be brutally truthful to yourself.

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

I understand your difficulty, it is hard to deal with your son and how much he misses your wife. I am sorry. Sadly, if that was a reason to expedite then everyone would expedite. USCIS reserves expedites for serious medical conditions, imminent military deployment, extreme humanitarian reasons, etc. I am sorry, but your son missing his step-mother doesn't fall into any of those categories.

Be strong for your son, perhaps have him chat with her on the computer, (skype maybe) so he can see her and they can talk.

Your reason is not good enough for an expedite. You should have submitted I-130 once you got married, it is easy to upgrade the petition once you get the citizenship. And if you want to save money, forget about K-3, go for the CR-1.

USCIS Considerations to expedite Cases

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

Where are you, in the process?

I suggest sticking with I-130, forget the K3, and follow http://www.visajourney.com/wiki/index.php/...he_NVC_ShortCut when yer casefile is at NVC.
