DS230 Questions About Police Certificate (Ly Lich Tu Phap) in Viet Nam

Hello All,

My sister submitted DS230 along with Civil Documents that included Police Certificate (Ly Lich Tu Phap). She made all copy of her DS230 and civil document before she sent to NVC. But she just got checklist letter from NVC. It said

" Dear:

We have reviewed the documents which you submitted in support of an application for an immigrant visa. Please review the information listed under each applicant's name and provide any documents which are indicated as missing or need additional information. You must submit the required information. Failure to provide the requested information will delay your immigrant visa interview.Please read the enclosed information to determine where to send all required copies of missingdocuments. If you have any questions regarding this letter, please call the National Visa Center at (603)334-0700 between the hours of 7:30am and midnight ET. Please include a copy of this letter with your correspondence and write your case number clearly (exactly

as it appears below) on the upper right-hand corner of all documents. If a period of one year passes without contacting the NVC (by e-mail, telephone, or mail), all submitted fees and documents will expire. Upon expiration, the fees and documents would need to be resubmitted in order to continue the immigration process.

When responding to the National Visa Center, please include the bar code sheet that came with this

letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

Please submit a completed copy of form DS-230 Part I, (Application for Immigrant Visa and

Alien Registration - Biographic Data) for this applicant. In reviewing the form that you submitted, we note that the section pertaining to applicant residences from the age of 16 is either blank or incomplete. The applicant must list all places lived for at least six months since reaching the age of 16. There must not be any gaps greater than six months. You will need to complete and submit a new form with the changes. Your visa application cannot be processed until this form is complete.

A gap exists in your residence history of more than six months. When completing the information in this section, please refer to the following instructions below on Police Certificate(s):

*Police certificates are required for each visa applicant aged 16 years or older, based on where each applicant lives or has lived previously.

*Police certificates are also required from all other countries where the applicant has resided more than 12 months. Present and former residents of the United States should NOT obtain

any police certificates covering their residence in the U.S.

*Generally, applications for police certificates should be made directly to the police authorities in the district in which you resided. The police certificate must:

*Cover the entire period of the applicant's residence in that area, and

*State what the appropriate police authorities records show concerning each applicant, including all arrests, the reason for the arrest(s), and the disposition of each case of which there is a record.

*If you have any questions about where or how to apply for police certificates in other countries, you may communicate directly with the U.S. consular office processing your visa

applications.

NOTE: Police certificates from certain countries are unavailable. Detailed information is available from the NVC or the nearest United States immigrant visa processing post.

She got only two original 1 she have already sent and the other one she keeps for interview. My questions is Does she need to resend the police certificate? or just sent the copy that she have made before.

Regarding your question...

In our case (CR-1) my husband requested the police certifiate and send it to me. When I received it, I sent it (with tracking) to the NVC (with the barcode). It was not requested that he submit another police certificate at the interview. In fact, before the interview, we received our packet 3 and 4 via email. In one of those packets, they list out exactly what we submitted and what was missing and/or what would need to be provided at the interview. Our notice indicated that we had submitted the police certificate to NVC and that it was accepted.

In your case, I would send them the original police certificate again, but I'm not sure how K-3s work, so you may want to wait for a response from others...

Timeline

Well you have several problems.

1. You need to go back to the website where you paid the DS-230 fee and print out the bar code cover sheet and include that in your reply.

2. You need to list every city/town/village where your sister has lived since age 16. Just because you send in one police certificate does not mean that the NVC will assume that is the only place where your sister has lived since age 16. You need to provide them with this information. You will also need police certificate from any place where she lived for more than 6 months.

3. They already have the original police certificate so there is no need to resend it.
