I found it!! Read through this doc to see if you and your employer qualify under the FMLA. If you do, you are authorized for up to 12-WEEKS of unpaid leave in a 12-month period for child birthing/care purposes.

additionally, i believe nessa has been taking personal time off or sick leave when she had to take off work to take care of our baby.

i discussed this situation with my boss today. he's not impressed with nessa's boss.

If she is taking her sick leave pr personal leave in lieu; the boss needs to shove a shoe in her mouth. That is nessa's time by law. I keep telling you: talk to HR about that fat old b1tch (I'm no hater, the boss IS a fat old b1tch)

PS - I voted 'other' because IF I were going to talk to HR, I'd talk to them about both. I'd first bring up #2 to lay the groundwork for her being petty and rigid. I'd then bring up #1 to see if her pettiness were contributing to her problem with taking time off for Ben.

It may be a case of both of you being 'wrong'.

Lay it out to your boss first what your concerns are, and let her know if you cannot solve the issues here and now, you will take the issues to HR for resolution. Go in loaded for bear, but don't come out being the rug.

Just keep in mind that if you have any chance at a future there, it will pretty much be over once you go to HR. Fighting the system never works. HR is there to protect the company and managers, not to help employees. If you can play the game and transfer out of her area, you'll be better off.

Yeah, above is a good idea... i don't know if i'd threaten to go to HR exactly, but definitely try to express your concerns one more time. If she is still unreceptive, take it to HR and tell them that you have addressed this X times directly with your manager, and still she continues to make the situation difficult/uncomfortable for you...

Also, as someone posted earlier, good to read up on the FMLA just so you know exactly what your rights are...

I would go talk to her and express that you totally understand that they need an employee who doesnt miss alot of work. which is true..it sucks when you have a baby and the whole 24 hour rule, but from her side..she needs someone who isnt absent all the time. i would venture to say she doesnt have children ;) i had a boss like that who hated when people had to leave with sick children(she had a child but had shipped him off to be raised by grandma, convienient eh?)

going to HR is pretty useless especially if you live in an at will state..you will have no basis of a comlaint. you are absent frequently.period. this is how they will view it.

it SUCKS to work with someone who obviously doesnt like you. It probably wont get better. The best thing to do is tell her that you understand and will do everything in your power not to miss work frequently.

forget the name thing...you will sound like a whiner claiming that so and so gets better treatment

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. considering that we live in a small town, job oportunities are scarce i'm not a citizen and won't be til probably 2012, where i can apply for federal jobs, that are easier to find, i think i'll just sukc it up and leave it alone. I have this feeling that if i do that it'll come back to bite me in the a$$. i know she'll start seeing me as a troublemaker and try everything to fire me or make me quit.

If you are still using the days you have per your contract, she has nothing to say, If you are asking for more time, maybe offering some extra hours to make up for that time, especially to help her when she is too busy may help. Is difficult to work in bad environments, sometimes is better if you put yourself in the other side too.
