USC birth certificate is.. missing. It's possible that MTL consulate has it, but what if they don't?? J sent me everything he put into the petition, but I don't even have a copy of his B/C. :blink:

Should I panic..? As in, try to get a b/c expedited from NY State for him delivered to Canada in a week (1 day before interview)? Which seems kind of approaching impossible, really..

All the USC needs is prof of American citizenship. Does he have a passport? I imagine so, if he ever comes to visit. We never used Bill's birth certificate. We photocopied all the pages of his passport and sent that in as prof. It is acceptable as well! So don't worry. Is he coming to the interview with you? If you didn't send in any prof of citizenship, just make sure he has his passport at the interview in case it comes up. If he's not coming, maybe ask him to send you a photocopy of his passport pages as prof.

Having an entire copy of the I-129F isn't a must, no. People suggest bringing it just in case they are mysteriously missing something from your file and claim you never filled it or sent it in. I think 99% of people never need it.

Yes, he's coming to the interview and he has a passport. It's weird though.. just so long as we're not missing something horrible that will deny us..

Oh god.. I hate these last minute panics... lol I already panicked about vaccinations I didn't even need, I wonder what else will come up? LOL

Hi KnJ,

Sorry to hear about your fiance's lost birth certificate. Unfortunately, I don't have anything to add about the Montreal consulate of about k1 visa forms.

But I do know that it takes about 1-2 weeks to get a certified copy of a New York State birth certificate, and the birth certificate is usually sent by USPS (regular) mail (though expedited service via UPS can be requested for an additional fee too). For more info about how to get certified copies of New York State birth certificates, you can read more here: http://www.health.state.ny.us/vital_records/birth.htm

As well, takes a few days to a week from mail to get from New York State (depending on which part of the state you are in) to Toronto (where you are, I think?). So unfortunately, you probably won't get your fiance's USC birth certificate in time for the interview you have in Montreal next week. So if need be, is there some other way that your fiance can prove their US Citizenship? For example, a US Passport, which is acceptable for immigration purposes as well.

Either way, your USC fiance is going to need his original or a copy of his original birth certificate for this immigration case, future immigration cases, and for other purposes too, so I suggest that he request an additional certified copy of such, just in case you can't find the original one and/or immigration won't return the copy that you gave them. And if your fiance does get their birth certificate, make sure they make copies of that too, just in case that gets lost or misplaced.

UHHHHHH does the USC need to submit birth certificate as part of the K1 visa? Or do you mean no USC with the original I-I29F that youre bringing?

The US citizen needs to submit a copy of his proof of US citizenship with the I-129f petition because only US citizens are eligible to apply for their fiancees to get a fiancee visa. A copy of the birth certificate, naturalization certificate or US passport is sufficient. For the interview, the interviewing officer has the right to see the originals of any of the documents submitted with the I-129f so they need to be sent to the foreign beneficiary - or carried by the US citizen to the interview with his/her fiancee. The US passport will be fine for your interview. They may not even request to see it, but it is best to be prepared. At the very worst, if you didn't have it, they would give you an RFE to produce the missing documentation and upon its receipt, approve and mail out the visa.

Days before my Interview for the CR-1 i went into panick mood because I didnt have a copy of my wifes birth cert! Piad big bucks for her to overnight it from DC to Mtl--They never asked to see it! belive it was sent in earlier,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

totally. I am surprised I'm not having more. Well. I panicked because I couldn't find the previous marriage certificate I had just ordered from the govt... and was searching EVERYWHERE. Then I realized I had filed it in my paperwork binder already. I'm too organized for my own good. :lol:

Actually...I just had that info fresh on my mind and on my computer...as I had to search for someone to contact for my son's birth certificate when they delayed it...(but that's another story....)...
