Working illegally while in process....

she should stop working immediately, and forget she ever had an SS# that was not issued to her specifically. Oh, and if your lawyer specifically gave you advice that doing this is OK, its time to fire him/her. Its never a good thing for a 'representative' of the law to advocate breaking it.

She would still be commiting fraud by not entering her place of employment info on the G-325A form, even with a SSN that doesn't belong to her..then again, she may or may not get caught. But if she does, the consequences are pretty harsh as I stated on previous posts.

Just do not put on the G325A that she was working or that she has a SS#. You all are being too judgemental and dont know the man's wife situation. A lot of people did that... and immigration turn a blind eye to it... thats why they adjust your status. You think that people who have overstayed their visas and then get married were just living and not working? Come on! They had to find a way to make a living... am sure it was just for work, not for the sake of identity theft.

Using someone else's SS# as your own still amounts to identity theft! If you steal a piece of bread from the store because you haven't eaten and are hungry, you still committed theft...it does not matter what your justification is. A more to the issue example: USCIS/DOS could care less why you misrepresented yourself, but if they find out you did, it is a lifetime ban.

Oh, and please refrain from advising people to commit perjury, or otherwise engage in illegal activities. It is against the Terms of Service(TOS) of this site.

Maybe the lawyer said that because he thinks since the OP's wife is using a different name at work, she will not have problems adjusting AOS because she will use her real name in her AOS application.

You have a point! In the company's payroll I guess, they used not her real name instead they used the name who ever owns the number. It shows that the owner of SSN has 2 jobs. It's illegal. She's safe if no one will report it to USCIS.

I wonder. Say an undocumented worker finds a SS card with a number and the name Jane Doe on it. She uses the card and works as Jane Doe a minimum wage job for years. What if the real Jane Doe, the person who lost her card, is a USC? Wouldn't this touch the heavy side of misrepresentation?

It is against the Terms of Service of this site to advise things like that. Just thought you should know.
