I agree with girl37 on this one. At this point, I would just wait. The only reason I did what I did was because my co-sponser lives outta state & I had to travel there to help him with the form. The only form I could download was the new version from the web site. Speaking with the immigration person at my congressman's office is what lead me to this decision. However, I still don't feel confident with it. You never know with these people!

I'm not Haydee, but the USCIS link is not the one they sent me this week. They sent me the old one.

Haydee and MrsWhizz,

I have just spoken with NVC about I-864. The lady said NVC is sending the old I-864 (which you received), but she also said that in the instructions, they said that you don't need to notarize it. So she says, the notarize area can be left blank. Have you noticed anything like that on your instructions?

I once asked NVC to clarify the use of the old and new I-864, here what I asked:

I've received from you Form I-864, version 11/05/01, to fill out. Meanwhile, I've found the current version (1/15/06) is also available on the USCIS website and I like it better. My question is whether I can use the current version now? If not, when can I use it?

And I was answered:

Dear Sir or Madam,

Your inquiry has been received at the National Visa Center (NVC).

To avoid unnecessary delay, please do not send downloaded forms. Copies of downloaded forms may be rejected and/or returned.

Please complete the version of the I-864 (Affidavit of Support) that was included in the package you received.

So last week I sent out the old one after getting it notarized for sure.

We received our RFE today and according to my husband, it was returned because we didn't put N/A somewhere in the form. No mention of it not being notarized, or only including one year's tax return. (We used the old form.) Sucks for us, but maybe it's good news for someone else. ;)

Sorry to hear that. Hopefully, you can send them out soon. We should not leave any space blank. Maybe have someone double check before you send it.

Yes, that is what NVC told me too. I will receive my I-864 anyday.

According to this the rules go into effect July 21, 2006 says even if you filed before july 21, 2006 these rules will apply read here.

I received my I-864 today and yes, we don't need to notarize it. Plus it asks for only the most recent year's tax return. The NVC operator told me that the notarized area should be left blank.

I have already turned in my I-864 and the DS-230. Although I did received the old form I-864 in the mail. I used the new one after some research on the above referenced USCIS sites. I found it so more understandable.

Oh my God, What was I thinking! :wacko: We're doomed! :crying:

Anyhooo, my spouse has been begging that I use James' shortcuts and who can blame the poor bloke.

I'll let you all know as soon as I hear anything and we'll know what may or may not work even though this seems a completely arbitrary process. :unsure:

Yesterday, I have received the I-864 packet. It is the old one. However, the instructions say that it does not need to be notarized. I called NVC and the operator told me to leave the notarized space blank. She reminded me just to sign and date it. Plus the instructions also ask to submit the most recent year's tax return. I filled it out and mailed it out today to NVC, NH. I will be happy to answer any questions regarding I-864 packet. Below are the items that I sent:

1. Cover Letter (saying what are included in the packet)

2. I-864 without notarization (pages 1 thru 6)

3. Authorization for Release of Tax Information

4. Letter from the Human Resources (Verification of Employment)

5. Last three most recent pay stubs' photocopy (Only the most recent one is required)

6. IRS Tax Transcripts of last 3 years (Only the most recent one is required)

7. W-2s of last three years (not required, if not a joint return).

The envelope that the NVC provided has NVC Zip code as NH 03801-2901, but the instruction mentions it as NH 03801-2909. I asked NVC about the last 4-digit discrepancy. She said, it is not a problem, but she suggested me to use NH 03801-2909.

Is that the actual copy of tax return, or will the transcript be enough? Sorry, i'm sure this has already been addressed elsewhere, but in the light of all this new form/old form confusion i'd like some clarification.

We also received the old I-864, but with instructions that say it does not have to be notarised (although did anyone else think this was very sneakily put it only one line of the instructions, with hardly any fanfare, so it could be easily missed?!). So i guess we will follow your lead, simple male.....

Standard response. I have never noted anyone sending downloaded forms to NVC that have had them rejected. Many sites have USCIS forms available that are not current and this is were the problem lays.

Yes, you don't need to notarize. I also spoke with 2-3 different NVC people who also confirmed me this. Believe me, they don't give me incorrect advice (as few member may think, NVC gives incorrect advice). So you can leave the notarization area blank. Make sure, you sign and date it. Plus in the cover letter, I did mention that I did not notarize it per instructions and I put a sticky note by the blank notarization area that it was not notarized per instructions. Yes, you only need to submit your recent year's tax return, 2005.
