hello everyone,

i dont know if any out there can help me to my problem. and keep searching to the internet how to solve this. ok i am usc and and had lots of relatives here. i got a problem to my mother she enter here as visitor visa i guess b,1 or 2 i dont know either of the two. well the think she decided to stay longer and now she stay more than a year i dont know how i can apply her to petition as immediate relatives my questions are:

how i can apply her how i can start?

how many applications i can used? should i send together?

should i can get lawyer for her?

it possible she can go back in her home country for while until approved the petition or stay here in u.s until approved?

i hope you guys out there can help me..thank you appreciated

Your mother is in overstay - more than 1 year will trigger a 10-year ban when she leaves the US. It would be prudent for you to seek the assistance of a family-based immigration attorney before you proceed - based on your questions, it seems you could use the help. :thumbs:

First of all, you should make an appointment with an Immigration lawyer for a free consultation so you can ask all your questions. But you can apply for adjustment of status for your mother by following the guide found here on VJ. Your mother should not leave the US until she receives her green card or she'll get banned from the US for 10 years.

Go see an immigration attorney. If your mother leaves the US, she is subject to a 10 years ban from entering the US. As a US citizen, a petition you file for her will take about 6-12 months to process. The overstay will likely be forgiven as she is your Immediate Relative (as defined by the immigration laws). However, filing a petition for her does not give her any right to be in the US, she is still deportable. So be careful and get yourself an attorney.
