Here's my 2 cents.

My husband was a VWP adjuster. It was not a planned thing. I didn't even meet him until he had already accrued a good amount of overstay. For this reason AOS was our only route.

To say this was nerve racking would be a huge understatement. We were terrified of the repercussions should we be denied. We knew it was possible that we could be, and in his case, he would have been banned for 10 years. I had visions of them dragging him away from me at our interview.

Luckily for us, everything went smoothly. I will say this though-if we had any other way of doing it, we would have. We literally made ourselves sick worrying. You have a safe option before you. The fact that you have already applied for the K1 may count against you. Just because a lawyer tells you to do something doesn't make it a good idea. There are plenty of examples of that here on VJ.

You might be able to adjust with no trouble at all. But you're not even married yet and you're planning your AOS. That has a ring of fraud to it, especially since you've already filed for the K1 and you don't want to wait.

The K1 process doesn't take that long when you consider the possibility of negative outcomes. Is your fiance willing to move to Canada with you?

Good luck to you.

MJHawk...

Regarding the wedding, after we realized there was no time to plan a big wedding before my visa expired, without me having to leave the country... We did Vegas... Afterall for a fast wedding where is better? We spent 3 weeks planning it and it was awesome - we made it totally about us... made it special, we stayed in a 5 star hotel... Got married in a cute little wedding chapel...

We're going to plan a big wedding in the next year or two for family and friends who have all fortunately been supportive.

Good Luck!
