section 221 (g) act f the prohibits the issuance............

*Petitioner: in a signed, sworn notarized statement, please submit a list of the names of those living with you at you current address. For each individual, include his/her date of birth, place of birth, phone number, and relation to you.

*Petitioner: in a sworn, notarized statement, please provide a detailed chronology (timeline) of your relationship. Please explain clearly when and how you first met, how you were introduced and when you began corresponding with each other, when you felt your relationship became serious, date and circumstance of marriage proposal (location, time, place, situation, setting, etc..) did spouse or fiance propose in person or by phone? where were you when he or she proposed (give exact location) did you accept immediately or ask for time to think about it? if he or she did not officially proposed, when did you first discussed marriage? how many trips did you make to vietnam to visit your spouse or fiance? How many times have you seen him or her in total? how long did you stay each visit? please give as many details as possible.

What happened when you submit docs for the Blue?

BN010809 and I myself both had benifiecirys go in OCt28th the first time and both of us got the blue slip telling to return Nov25th. But they only wanted the timeline from me. She went back in again today. Stood in line around 12, and didn't get out til 5. She wasnt asked anything else, just to submit the old blue slip and new evidence. AGAIN another blue slip. This time the letter was in mostly english(shes still learning and at the time really sad and didn't want to try and read the paper for me), put she did read off Section 212(a) 6 © i. Did a little searching around, and if im not mistaken under that code/law it means

IN GENERAL. - ANY ALIEN WHO, BY FRAUD OR WILLFULLY MISREPRESENTING A MATERIAL FACT, SEEKS TO PROCURE (OR HAS SOUGHT TO PROCURE OR HAS PROCURED) A VISA, OTHER DOCUMENTATION, OR ADMISSION INTO THE UNITED STATES OR OTHER BENEFIT PROVIDED UNDER THIS ACT IS INADMISSIBLE.

This really sucks, but when she gets home later shes going to email me the slip, and i'll start thinking or finding out what i have to do next when i know more. Has anyone got section 212a.6.c.i ?? :crying: ANyone maybe start pointing me to the right way..

If she got the cited section of the INA correct, then the visa has been denied, and the petition is going back to USCIS. Essentially, the consulate is accusing her of willful misrepresentation (i.e., visa fraud).

Your first course of action should be to get a lawyer ASAP. Try to keep the petition from being returned to USCIS while you submit more evidence.

If that fails, then you have to wait and see what the USCIS service center does with the returned petition. If they reaffirm it, then your fiancee will get another chance at the consulate. If they agree with the consulate's decision, then you'll probably receive a Notice Of Intent to Revoke (NOIR). DO NOT IGNORE THIS NOTICE! You must submit an appeal, and you won't have much time to do it (30 days is typical). As soon as you have a copy of the denial notice, start preparing your appeal. If you don't submit an appeal in time, then the 212(a)(6)(c )(i) is going to become a HARD finding, and your fiancee will probably receive a ban for it. Abandoning the K1, getting married, and filing for a CR1 isn't going to make this go away. Your fiancee (your wife, at that point) wouldn't find out about the ban until she showed up for the CR1 interview.

The Blue slip usually cites the same 212 section about fraud.. within the 221 part of the form... It seems that they are in AP....

Every blue slip I've seen posted on VJ for RFE's or AP cites 221(g), which is about insufficient documentation or evidence. Even when they say they don't believe there's a bonafide relationship, they don't cite section 212. Section 221 is about the requirements for getting a visa. Section 212 is about inadmissible applicants. Section 212(a)(6)(c )(i) is specifically about people who are inadmissible because of misrepresentation. I've never seen this section cited on anything other than a denial slip.

Wow, Congrats to both of them...so, they're now can celebrate Christmas togheter, it's so wonderful christmas gift.

Hello everyone!

I had an interview in Nov 24, 2009 and got Blue sheet with the same as BN010809. I really want to know how can get PINK like BN010809 did in the second appointement?

My husband will come to VietNam to support me. Could you help to give me some advices:

- Will my husband need to visit CO before the second appointement?

- Will my husband need to submit all documents before the second appointement?

- Will my husband need to write an email to them in advance?

To BN010809 : Congratulations. Could you share some information that help you to get PINK ? Thank you.
