Hello Everyone,

For those who did an AOS from a H1B visa, how do we answer Question 11 on the I-765? Currently, I'm on a H1B visa. I had applied and was approved for the H1B when I converted it from my F1 (student) status. As a student, I had also applied for the EAD after my graduation(OPT).

Do I enter the information and attach documentation from the OPT process for Question 11 OR do I enter information and documentation of my H1B status? OR do I just add both?

Any ideas, thoughts, advice would be appreciated.

10/10/09 - We got married!!

10/21/09 - Completed and Received Sealed I-693

11/16/09 - Mailed I130, I485, I765

11/17/09 - AOS packet received and signed for by SPARNELL

12/10/09 - I130 "touched"

02/17/10 - Received "Card production ordered" email for I485

02/19/10 - I485 "touched"

This is the current forum :star: I don't have much experience with H1B but my husband did fill out the I-765 with his AOS. Since you noted that you have applied for an EAD before you will want to attach all documentation regarding any application including if it was granted/denied as stated in part of question 11. To clarify, did you only apply for an EAD while on the F1? Since the H1B is a work visa I wouldn't think you would need to apply for an EAD. My husband is on a J1 which is also a work visa and we put "no" for question 11

I'm applying for AOS from a H2B visa... Different to H1B but still another H work visa. I was advised that the employment authorization they are asking about on the i-765 is if you've applied for an employment authorization card before. work visas don't count for that question - as it was your employer that filed for your H visa employment authorization not you.

So I believe for your H1B the answer is no...

However I am not sure on your OPT for the F1, but i'm sure someone will know on here. Did you personally apply through a USCIS office for the OPT? and did they send you an employment authorization card? As if so maybe it would be a yes... And then just the details on your OPT EAD.

RebeccaAndPhil: Yes, the only other time I've applied for the EAD was when I was a student on the F1. And they did approve and send me the EAD card.

In that case just send the paperwork from the F1 EAD and you should be fine :thumbs:
