I am trying to find out how to get justice for a rape and resulting child in the Philippines, but having a hard time finding out where to go for that online. Family is raising the child that was forced on this person through a violent rape.

Ideally I would like to see this man in prison, but would be happy enough to see that he is forced to pay child support for the innocent girl. I would gladly strangle him if I could get my hands on his throat.

Status of Limitations may have resulted in this and nothing can be done now, But a PI criminal attorney would know the answer

They have what is called a "Police Department" in Philippines, and that is where one would start...............

In the OLD DAYS...contacting a LOCAL "man of honor" would usually take care of the issue,

nowadays those people are non existent, actually most the time those are the ones involved in the most disgusting activities including people smuggling.

So that option is HIGHLY NOT RECOMMENDED...for additional reasons, once in bed with those good fellows, the favor is never actually repaid but it become a lifetime loan.

Other than cleaning up a total corrupt system,including the overall of the justice apparatus and their idootic medieval laws ...you can draw your conclusion how much can be done for a local rapist.

On the other hand, if rapist is a FOREIGNER still living there, the government will put up available resource, create a media madness, just to create a show of force for the people.

Rape is considered a henious crime under Philippine laws ( RA 7659) and for that it is punishable by death. Again under our penal laws, crimes punishable by death will prescribe in 20 years , therefore the victim still has a cause of action .

Did she report the rape to the Police officers? If not, then have her go to the police station so that it can be recorded or blottered.

Did she go to a doctor after the rape? If yes, let her get medical records showing the results ( bruises, tear on her private part etc). You did say it was a violent rape.

After that have her go to the Prosecutor's office of the place where the crime was committed to formally file a complaint.

The tricky part would be if she has no medical records to prove the rape , it will be then her word against the person she claimed raped her. He can always say it was not rape but a sexual intercourse with her consent.

As to getting child support, we do have laws on this but is not strictly implemented like in the US. Many single mothers struggle to raise their kids with the help of immediate family and a number of them find greener pastures to make life easier.

Depending on the region, this might be impossible. I've read stories where a rape victim will go to the police and be ridiculed rather than helped. I've also heard from people who have lived in various places, and some who still do, that say most of the police are corrupt. An officer is usually unlikely to help unless there is personal gain involved. A few are good people and genuinely want to serve and protect, but most don't.

I've even heard of situations where the one calling for the police ends up being abused and/or arrested because they wouldn't pay the officers a bribe.

This might not apply in all regions or locations. It could be that most police are good people who serve justice well. But I'm just relating the information I have, which has few positives regarding police in the Philippines. I suggest trying to find out if the police in the victim's area can be trusted before going to them.
