Hello all,

I have to cut this long story short. My girlfriend filed her I-751 to remove conditions based on divorce waiver (after divorce with her X)and subsequently she got interviewed. Immigration officer at the interview said that he will let her know later if the petition is approved or not. She has been waiting for last 3 months and nothing yet. Now we have our wedding coming up and for that she needs to travel to our home country..and it is very important and we cannot delay this. She has a stamp in her passport though. Can she travel safely for 2-3 weeks? or at POE officer will creat a problem to let her back in USA? I need a very sincere advice on this one. Thank you in advance.

if she allready had an interview 3 months ago than she should already should have recieved her card .since she has not i think she should seek some help from rep or sen to find out that wht is goin on with her approval.

As far as traveling with stemp , i think she can travel but i m sure she would have to wait at the airport and she would be interviewed there . i m a waiver filer too and too have a stemp in my passport i wanted to travel out of country but i just did not want to take risk so i just changed my mind not to travel before i get approved .

what are her timelines?

Most folks do not have issues at the POE when traveling with their expired PR/Green Card and 1-year extension notice (NOA1 from the I-751), she may not either but it would be worth it to find out exactly where she stands with her 10-year residency card before traveling. Am confused though - in a recent post, you said your interview was the middle of October (2 weeks or so ago, not 3 months ago).

to my understanding the 2 weeks ago was for his ROC and the 3 month ago was for his fiance's ROC ,

so my guess is they both migrated here got devorced from theyr previouse spouses and want to start a new life together and waiting for the fiances CG to arrive , as to the stamp i seen posts where they traveld with a stamp without any problems , but since its been 3 month since the interview aproval I would contact them

I have mostly seen approvals and denials given soon after the interview or up to 90 days. Or else the file is under review for more investigation. Could take more than a year in some cases. Its hard to predict.

I hope this is not a scam. I see 2 conditional residents removing conditions at the same time and getting married. I hope its just coincidence.

Waivers could take more than 2 years sometimes. What does her lawyer say?

Lona is absolutely right. I m not spam otherwise I wouldn't have posted here under my own ID. My only concern is what are the steps after if She gets denied while she is out of USA?Will they atleast let her enter USA and file for MTR or appeal before the Immigration Judge???or they have right to just not let her in and send her back??Is there any way we can find that out now???

I needed to know the circumstances of her case to guide her better. I have send you a private message. An allegation of fraud may be a ground of inadmissibility to deny entry. Appeals and entry comes after entry. I would advice do not travel.
