Timeline

Could someone please inform me about the exact procedures after filing I-130 for a spouse living outside the US? Our problem is as follows:

my husband filed I-130 for me in US on Oct 13, 2009

he received NOA1 on Oct 22.

I am in Poland and since I've got a valid tourist visa I want to go to him in November and stay there 2 or 3 months. However, I don't know whether I would need to show up in the US embassy in Warsaw in the meantime. Should I stay and wait for instructions or can I go as, practically, in the nearest 2-3 months I won't be asked to show up in the embassy? How was it in your case?

It all depends on your husband. Now that the I-130 has been approved, it will be transferred to the National Visa Center for processing. They will ask for a Choice of Agent which is the person you decide will receive all correspondence from the NVC, usually the petitioner, in your case your husband. You can still come to the US with your tourist visa and delay the process at the NVC. The way to delay it is by not sending the documents or payments they request right away, take your time with it and slow it down. The process without using any shortcuts can take up to 3 months, by the time you're done at the NVC you can go back to Poland for your interview.

I don't think that I-130 is approved now. We only received NOA1 and the case is at the "initial review" stage. How will they contact me about the choice of the agent? Should I wait for the correspondence form Warsaw embassy or will they contact my husband? If the correspondence is, at this stage, only between the petitioner and the Immigration, I think I can leave the country now. Am I correct? Anyway, thanks for your answer :)

If you come on the VWP, then it is up to the immigration officer if you are admitted or not... That is based on you showing ties to Poland (university, leases, job) something that will convince them that you will return to Poland to finish the procedure and not stay in the US... If they feel you do not have enough compelling ties to your home country to return.. You can be denied entry to the USA and will have to wait in Poland..... There are many here who have successfully stayed here in the USa and retruned to the home country, so try to read some threads about this to get an idea of what to expect...

That is based on you showing ties to Poland (university, leases, job) something that will convince them that you will return to Poland to finish the procedure and not stay in the US... If they feel you do not have enough compelling ties to your home country to return.. You can be denied entry to the USA and will have to wait in Poland..... There are many here who have successfully stayed here in the USa and retruned to the home country, so try to read some threads about this to get an idea of what to expect...

The problem is not whether I'll be admitted or not. I only want to know whether I can travel easily in the next 2-3months and get back to Poland to finish the procedure or Should I stay BECAUSE I MIGHT EXPECT SOME CORRESPONDENCE FROM THE EMBASSY IN WARSAW DURING THIS TIME?

My understanding is that at this stage, it is my husband's petition for me and they will contact him in the US and not me in Poland till the case is approved and forwarded to NVC.

Seems like I'm talking to myself :) But finally, I called the embassy in Warsaw and got to know that I can travel to my husband freely as They'll contact him not me at the moment. Of course, it's the immigration officer who decides whether I should be admitted to the US or not.

Are U sure You can go to Usa on your tourist visa???can U tell me what,s the number to Warszaw Embassy to call and ask about it?

I'm sure. I asked twice. Your tourist visa is not automatically canceled once you start the procedure. You might not be admitted to the US by the immigration officer but you can travel.

You can phone the US embassy in Warsaw and ask: (022) 625 10 42, Mon-Fri 10-12am, 2-4pm.

Sorry - missed that part of the question.

You won't have any contact with the embassy/consulate UNTIL the P4 packet is sent to you. That's basically one step away from the last one.

Figure 5 to 11 months until you receive the P4 - depending on speed at USCIS and speed at NVC.
