I got a question, I arrived in the States may 13th, our weddingdate is the 5th of August.

Which is like a week before my K1 expires, it`s a short notice, I agree, but we needed time

to plan the wedding and stuff because we don`t want to have some cheesy wedding.

Anyway, according to us we should be fine since we ARE still gonna be married within the

obligated 90 days !!.. Our pastor promised us already to PERSONALLY handle the paperwork after

the wedding and do this within 48 hours!...(it`s his 'normal' service but I asked for it specifically, cause

of the short notice.)

Now ...on the guide for AOS I read that you have to file the I-485 (and other AOS paperwork) before

your K1 expires...??!!!

Is it gonna be a big problem if it`s gonna be after this time?? Do we need to worry about this???

I mean, as far as I always understood while filing and going through the whole procedure to get my

Visa, is that they constantly mention the importance of getting married within 90 days, which is exactly

what we do, so we should be fine...................right??? :hehe:

You will be fine there is not timelimit for filing your AOS some have waited a few months other have filed before the K1 expires.... so no problems if its only going to be a few weeks...

You will only run into trouble using the AP if you were out of status for more than 180 days NOT 90 days.....

When your K1 visa expires is not relevant. When your permitted stay in the USA expires, as indicated on your I-94, is.

But you don't need to have applied for adjustment of status by then. It's desireable, but it's not essential.
