K-3 questions

Timeline

My fiance is American and I am Canadian. We are trying to decide where to get married. If he is going to apply for the K-3 visa in his country, do we have to get married in the USA ?

We have been told that the K-3 is the better way to go, so I can work that much sooner. Is this true ?

Any insight given is much appreciated !!

The Cr-1 allows for immediate work and travel. The K-3 is slow and expensive. Unless you interview in Vancouver then it might be beneficial but without that information we cannot help you

There isn't a filing fee for the second petition but you need more than a visa to enter the USA. You also need permanent residency status. CR1 enters with that status. K3 pays $1010 to adjust to that status and waits months for work authorization while doing so.

Filing the K-3 is free. The $1010 you must pay to adjust status from the K-3 is what I was refering to.

Yes we did the CR-1. We seriously considered the K-3 but are SO happy we didn't go through with it. Like I said, only if you will interview in Vancouver is the K-3 beneficial as it is significantly shorter wait time than interviewing in Montreal, where in Canada are you from?

k3 is much better than cr1.. its faster than cr1 but there are difference between k3 and cr1. and its quite expensive than cr1..

K3 is no longer faster. It's just more expensive. CR1 results in the immigrant having work authorization upon US entry.

actually you are not yet in K-3... you are in parallel paths for either the CR1 or K-3 and you will make your final visa decision after petition approvals

When I look at the interviews scheduled for K3 and IR1/CR1 on the Chennai (India)) US consulate site the receipt numbers for K3 are having an earlier dates for interview than the IR1/CR1. They have the interview schedule along with the receipt number on the website there. They are on the Chennai consulate site.

For a lot of people even saving 1 month is a lot more important than spending a few thousand dollars extra down the road or not having the work authorization immediately. I am still in the process I cant exactly say what is faster from my personal experience at this point but even if it would save me a few weeks I would gladly do K3 over Ir1/CR1. For me I just want to be with my wife as soon as possible do I dont have to go through the stress of separation.

9/1/2009: Applied for I-130

9/14/2009: NOA1 for I-130

9/21/2009: NOA1 for I-129F (CSC)

9/25/2009: NOA1 received for I-129F (receipt of mail)

01/08/2010 : Thank you very much Jesus..... NOA 2 129F

01/08/2010 : NOA 2 I-130

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

01/20/2010: Embassy schedules interview for K3

02/19/2010: K3 interview over and approved.
