Question about Conditional resident

Hi,

First of all, thanks to all Visajourney members. My wife got her Immigrant Visa yesterday!! I'll post our interview experience in another thread, but overall it was pretty simple. A few basic questions, and we got the Visa quickly. DCF was quick!

Now, could someone explain CR-1 versus IR-1? We have been married for close to two years, and our 2 year anniversary is in November (2009). I saw some detail about us needing to file a few separate forms at the end of 2 years of marriage.

Will this be needed, since she doesn't yet have the conditional green card? If we enter the US AFTER our 2-year anniversary, will she get a non-conditional green card?

I recommend entering the US after the anniversary so your wife gets a 10 year GC and doesn't have to file the removal of conditions.

HOWEVER, make sure to notify the CBP officer at POE that she has been married to you more than 2 years even though her visa says CR1.

I know many CR1 visa holders who entered the US after their 2 year anniversary got a conditional GC because the visa is CR1.

They had to file I-90 for replacing it to a 10 year one.
