If a passport has been expired for more than 2 years (or some other duration, can't remember) it is treated as a first time application all over again and can't be renewed so it's kinda like losing your passport.

I guess it would be more accurate to label it as a renewal of passport or treated as an application for a new passport? I won't presume to know how the Philippines embassy in the USA would treat this matter.

But when I was in the USA before and had to renew my passport at the Philippines embassy in Chicago, they made me courier my old passport.

They treat it the same I would imagine. Renewal of passport is easier and needs less documentation. New applications need more paperwork. If the passport has been expired for some time, they won't make it as easy as renewing your passport if it's only been expired for a year.

And they always ask for the old passport. They have to put holes on the electronic thingy so that it can't be used anymore, especially if the passport hasn't expired yet.

That's the risk of illegal immigrants... they can stay in the US and risk being arrested/deported or they go back home and not be allowed to enter the US again ever (or for a couple of years). I have friends who have parents who came to the US illegally and they can't come back home and they can't petition their kids so they're just kinda stuck in limbo. Kids can't apply for a tourist visa unless they're willing to lie to a CO so they go on years or decades without seeing each other. Makes you wonder if it's really worth being an illegal alien when you miss your kids' weddings and don't get a chance to meet your grandkids.

Not an expert on this so I could be wrong.. but I'm not sure what he is worried about.. If he is caught wouldn't they just deport him?

I was thinking the same thing... Contact the Philippine embassy, they issue a travel document and you go home... If not, immigration gets contacted, he gets picked up and sent home... Same result! He goes home...

Illegal immigration will always be a current issue, the date of the OP's post notwithstanding. Yes, hopefully the seaman made the right choice to come home. If he had the chance to adjust status (such as satisfying 245(i)), we wouldn't be hearing about this story of 15 years being illegal.
