Illegal immigrant for almost 15 yrs...

Hello Everyone I got a question about a Filipino man that used to work on a Seaman Ship coming out from the Philippines. He has been on the ship working for about 10 years or so and has came to the US on various trips. I just heard that this man just ship back in 1997 and has been basically hiding in Washington State illegally living with a family member who has been taking care of him. The Filipino guy has never really had a real job since he has no real Social Security or anything stating that he is a US Citizen. His old passport is already expired and he has never contacted the Immigration or anything about his situation. I asked him while in Seattle that how he actually got here and he said that he jumped ship thinking that he would have a better future for his life. I also talk to some of the family members who are taking care of this guy and some of them are really burdened about this Filipino man who can't help in paying bill and buying food. He told me that he is going to just get his passport renewed and just get ticket and fly back to the Philippines after hiding here in the US for near 15 years. I told him that it is not going to be easy and he is lucky the cops have not found him yet. He still insist that it's that easy for him to just get his passport and fly. I don't think they will renew it because of his non compliance with immigration. I would like to see this man get back home but I know that if he does get a ticket and try to fly back that somehow he will get arrested and thrown in jail. What should I tell this guy? If this guy gets caught at the family house by immigration authority then will the owners be prosecuted for having this man stay with them? Anyone who thinks they have is knowledge on this and knows Philippine Immigration Laws then send me them so I could tell them to this family please.

06-27-2014 RFE for I864 and I864A (i left the Place of residence blank, 26 days from the date they received the AOS)


06-28-2014 Mailed the corrected forms to NVC


06-30-2014 NVC received the AOS corrected forms


07-01-2014 Received IV Bill Invoice, paid.


07-02-2014 PAID status of the mother


07-07-2014 PAID status of the father


07-08-2014 Mailed the supporting docs

09-04-2014 Called NVC and the lady said CASE COMPLETE! (136 days total from the day they received the I-130)

10-03-2014 Interview/AP/USEM (no record of their medical,DAD needs to get an NBI explanation letter&new NBI clearance with his "aka"


10-8-2014 Mom called St Lukes and asked about the medical results, they said they submitted it already back in June


10-10-2014 Mom mailed the NBI Clearance of my dad


10-14-2014 NBI clearance delivered in USEM

You're obviously a caring dude, but I don't see how this is "your" problem. If I were you, I'd avoid involvement. Also, VisaJourney is not exactly the proper source to consult regarding The Philippines' immigration laws.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If he manages to get a passport (n ot sure how easy that would be), and has a ticket to leave the country he is very unlikely to be arrested. He is leaving anyway, so they will just let him leave, but he won't be able to come back.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

He should be free to get a new passport from his own country by going to his local consulate and as soon as he gets it, he's also free to buy a ticket to go back home. Immigration will not care one bit if he's leaving. He shouldn't have any issues.

He should contact the Philippine Consulate for assistance and renew his expired passport they will help him regardless of his immigration status, then buy a ticket and go home.

It's not unusal for Filipinos to help a fellow Filipino in dire straits.

To OP, here are some info from the Philippine Consulate website in LA.

The Consulate helps and protects ALL Filipinos, regardless of their immigration status. A Filipino who has no legal immigration status in the United States deserves the same assistance as that accorded to a legal resident.

How does the Consulate deal with cases involving assumed names, or in the case of seamen who jump ship?

Cases involving assumed names, and cases involving seamen who jump ship, are treated in the same way as lost passport.

What are the requirements for the replacement of a lost passport?

Lost passports can only be replaced when the consular officer can determine that, in addition to meeting the minimum requirements for a Philippine passport, that the applicant has actually lost his or her passport.

The documentary requirements for the replacement of a lost passport are essentially the same as for a first time application. Additional supporting documents may also be required to establish the applicant's identity, Philippine citizenship, and the circumstances surrounding the loss of the passport.

In addition to the documentary requirements, the Consulate General has to receive clearance from the Department of Foreign Affairs in Manila to replace a lost passport. Due to the significant volume of such cases, the mandatory waiting period for the clearance normally takes 15 working days (3 to 4 weeks - do not count Saturdays, Sundays and legal holidays) and another six (6) weeks will be required for the issuance of the new passport.

YOur friend needs to contact the local philippine consulate closest to your friend............i know that I read that they will help any Pilipino no matter what their "status " is..............(at least the one in ny said that on its website) I believe they can help him perhaps w his passport

I find it strange how a seaman who jumped ship is treated as someone who lost his passport even if he might actually have his expired passport.
