Approved with no interview??

Ok first offf, as the topic states, today my fiance and I got a notice of approval, after waiting less than 3 months. Thing is, looking at the USCIS chart, we are already in the "post-decision" state, which is WAY after the interview. Does this mean we don't have to go through the interview process? Perhaps sent enough evidence/were easy to look into?

Another BIG question here: It is the end of October, and we were not expecting it to go through so fast, seeing as how most people waited around 5 months. We were planning for more a moving trip around spring, perhaps March or April. Does this mean I am forced to move to America even early than expected? How many months is it before I would for SURE have to move and marry? Our next trip planned was going to be me coming to America in January for a visit, but would this not be possible?? With the busy Christmas season just starting up too, I'm not sure if I would even be able to quit my job so soon too, not until at least after the end of January.

Sorry, I am just a little stressed, and confused with what our plans were going to be, judging at times, and being approved THIS fast! Just feels like I need more time to take care of some things, so I'm not sure how much time we have before I must move.

difference between petition approval and visa approval... petition approval rarely, if ever, has an interview... you have petition approval... not yet a visa

Hi!

Sounds to me like you are confused about the process. First the USC petitions for the foreign fiancee (you?) and then the petition is approved. After that it goes to NVC, then the consulate (where the interview is). You've still got a ways to go - and many months if what I read for your fellow Canadians is true.

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Your approved with the petition but this doesn't mean you do not need an interview, it is just the beginning of the more stressful waiting process...but your way to go for another 3-4 months...after your approval the case will be move to your country in where you will be interviewed then.You will have more time to prepare before it happens to move here in America.

*WHEW* Thank you for clearing that up... As much as I want to be with my fiance, I was worried it would be WAY too much of a rush! Of course, the times can vary but I was checking the charts posted and even in the shortest amount of supposed time, it will still be ok.

Not to mention, I thought I remember reading that you ONLY get 3 months to move, not 6. I'm glad that I still have alot of time left! Thank you...

Seems that try as they might USCIS just cannot grasp the concept of the online update. Your petition is approved, not your visa. You will now get notice that it is being sent to the consulate, then you will go through the process ofr an interview at the consulate, and THEn get visa approval and issuance.

AFTER you get the visa in your passport, which coul dbe another 2-3 months, you will have 6 months in which to use it to enter the US, so you have a good 8-9 months before you MUST enter the US using your visa. 2-3 months minimum

are you talking about the online update thing? most of the time it is NOT accurate. mine is still on the interview chart when i already had my interview lol. good luck to you and.. well, take a deep breath. lol. ^ that flowchart website was very helpful for me during my process

once approved (after the interview @ the embassy), you will get your visa in hand and from then, it will be valid for 6 months, so if you want to leave by march or whenever, your visa will still be valid. it will show an expiration date, dont worry! lol.

at this point.you have ample time to prepare everything ;) you have to gather ur paperworks:

- PROOF OF PAYMENT (visa application - for Phils, it was $131, not sure with urs)

- PASSPORT. You must have a passport valid for at least six (6) months

- birth certificate

- certificate of no marriage (if never been married) of benifiaciary

- PROOF OF TERMINATION OF A PRIOR MARRIAGE (divorce decree, annulment decree or death certificate, etc.)

- police clearance of all countries you have lived in since 16 yrs of age

- COURT AND PRISON RECORDS: Applicants who have been arrested, charged or convicted of a crime must present copies or transcripts of court or prison records relating to the crime or offense

- evidence of having met within the past 2 years (pictures, his / your boarding pass to visit, receipts while together, etc)

- evidence of engagement (receipts of gifts you bought for each other, emails, snail mails, phone records, photographs

- VISA PHOTOGRAPHS

- medical examination @ accredited hospital in your area (do a lil research, idk about canada lol XD)

DS-157 SUPPLEMENTAL NONIMMIGRANT VISA APPLICATION (2 copies) <- once you pay for the application fee, the bank will give you ONE copy of this form, with the receipt attached and a stamp on the back of it. make sure you keep the receipt attached. this will be one of the 2 copies you will bring with you during the interview.

DS-156K NONIMMIGRANT FIANCE(E) VISA APPLICATION ( 1 copy )

A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

(about the evidence of support and his income tax return, it will be asked from you during the interview. right now, have him prepare his ITR, prepare the AFFIDAVIT OF SUPPORT AND HAVE IT NOTARIZED, FEDEX it to you. PLEASE dont use USPS. i had horror stories about it lol)

i had a bit of struggle only on "proof of engagement" as i was not sure how to show that we communicate regularly - we only used skype to call each other, we dont email on a regular basis, we dont do snail mail...so i printed out receipt payments from paypal for our skype credits, my facebook emails with his mom, a few pictures and the receipts and boaring passes that we had. the consular officer asked why i pay for skype, he was like "i thought skype was free, why pay for it?" and i told him "well, you can get credits with ur CC /paypal so you can make international fone calls on a cheap rate.. then he only looked at 6 out of 15 pictures i presented then said "congratulations, your visa is approved" then handed me my pink slip ^_^

good luck and i hope this saves you a lot of time for gathering ur paperworks. i was rushed coz i didnt know about all these other things and i had to reschedule my interview coz i knew i wouldnt have the paperworks ready by then.

you are just on NOA1 and you can never tell if they will request for further evidence (RFE) before issuing you with NOA2 but its good to have all your papers ready as early as possible, so you dont have to cram LIKE I DID -_- lol ! good luck and let us know what's up!! :)

P.S. they only asked for the affidavit of support and Income Tax Return, but it wont hurt to have his W2 and employment certificate; bank record handy. they might ask for it :)

Hi Spiky, welcome to VJ!

As many others have said, your I-129F petition was approved. Your fiance's case will now be sent to either the Montreal or Vancouver consulate (depending on where she lives). She will then receive a package with some instructions on what to do next.

Wait times for the 2 consulates are quite different for an interview. Vancouver is about a month, where as Montreal varies quite a bit. I will have waited 4 months for my interview (from the time I sent my package back) and some people waited only a month.

The regional service center has approved your petition so it will be sent to the NVC for case number assignment and then to the the embassy. The embassy will set up the interview and physical. Good luck :thumbs:

Hi Spikey! Welcome to VJ! Are you going through the Montreal or Vancouver Consulate? Big difference in how long you'll be waiting for an interview...
