Wife has got VISA and living with me, what now?

Hello,

My wife has received her CR1 Visa and is now living with me in Arizona. I am really just curious what the next step is for my wife? Do i need to get her a green card? do i need to do an Adjustment of Status? get her a social security card? I want to make sure I get her all the required documents.

thanks in advance, I did some searching on the website but couldn't find a definite answer; so hopefully one of you all can guide us in the right direction?

When did she enter the country? There seems to be a new procedure after POE where they send an I-797C request for biometrics and applicants have to get their picture taken as well as fingerprinted. GC comes around 10 days later. See this post:

The next major thing you've got to do is removal of conditions, so you might want to go to that forum and have a look. You'll be filing for removal of conditions in approximately one year and nine months, but go over there for more details on the window of dates.

Start a folder with evidence of your bona fide marriage. Any joint documents you collect, financial things, insurance, lease, etc., as well as joint social things. It's easier to collect such joint evidence as you go rather than all at once. Again, look in the removal of conditions forum for ideas of what to put into your folder of evidence.

You can come back to this forum in about three years to file for citizenship, if desired. But that's an optional thing.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

hmm so i looked at few other ppls post, and it looks like i need to wait for the NOA I-797C to arrive in the mail? Is that the absolute next thing we must do/wait for?

or is the FIRST thing we have to do is get her an appointment with USCIS to do biometrics?

She doesn't have to do ANYTHING. Her GC and SS card should come in the mail shortly. Like within 6 weeks of arrival.

Next thing will be to file the I-751 in about 21 months.

First thing you need to do is just enjoy having your wife home....

With a CR1 there is no Adjustment of Status, she was granted immigrant status at the POE. Her green card & SSN should arrive within a couple of months.

Within 3 months before the 2 yr anniversary of her admission to the US you will want to file for "Removal of Conditions". Right now she has Conditional Legal Residency, the condition is being married to you. Once the conditions are lifted she'll be issued a 10 year Green Card.

My wife has been with me since September 16th and we have yet to receive any paperwork in the mail. So I guess we just need to continue playing the waiting game?

one last question, after she receives her green card, how long is it initially good for?

If she came in September with a CR1 visa and doesn't have her green card yet, you have a problem. The same is true for the SS Card. What I'm seeing currently is both arriving within 30 days. You may have failed to check the box requesting an SSN and Card on the DS 230. Just go see the SS office near you.

Did the CBP officer take the sealed envelope from your wife when she arrived?

Are you sure it was a CR1 visa?

Are you sure it was a CR1 visa?

yes, I am positive it is a CR1 visa, her passport stamp has CR1, and so does her VISA. it has only been 1.5 months since she has been here, so it may take a little longer.

and I am positive i checked the box on the DS 230 :)

They sometimes don't send a SS card even if you check the box. I'd go to the nearest SS office to check on the status of her SS card just to be sure she is even in the system. Even the government can make mistakes from time to time. :whistle:

Have you had a change of address since you filed the I-130 petition? If so, you won't receive any notices - the POSTAL SERVICE does NOT forward any USCIS/DHS notices.

Suggest you call USCIS and inquire about status with a human.

re: SSN - easy to go into SSA office and apply . If they have no record in the linked system - don't finish up the application - there's a data error somewhere else.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I don't know exactly what govt agency to call but i'd say you have to find out and call.

I arrived here August 26. A few weeks later (3-4 weeks), i got a mail from a doctor in California and inside it was my greencard!!!! The post office sent it to the wrong state DESPITE the fact that the letter is addressed to our TN home with my name on it.

It might have gotten lost or stolen, you never know.
