Another I864 Thread

My husband is currently filling up the I864 form.

Couple of questions/clarifications.

1) Does it have to notarized? I keep seeing differing answers on this.

2) He has moved back in with his parents after graduating from college and will be living there till I get there and we get our own apartment. They file their own taxes, he files his own. His parents aren't claimed as dependents on his tax return, I'm not sure if he is on their's. So, what will the household size calculation be? 2 (for the two of us) three (for him and his parents) or four including me? We think it's two and someone else concurred on two as well. Affirmative?

3) Do his parents have to sign anything? Yes? No?

4) My cousin will file as joint sponsor. His income is enough to support him and his wife and daughter and me, the intending immigrant. I was told that his wife will also need to sign an I864A. Correct?

No your I-864 does not need to be notarized.

Read I-864 instructions on how to calculate household size. If his parents are going to promise to support you with their income and resources, he would need to count them in household size (if he lives with his parents principal residence).

Not to complicate matters, he should just use 2 and forget about the parents support. His parents are not his dependents.

No. Not at all unless they are going to be sponsor you as well, then they have to have a promise etc (Read I-864/A instructions).

Your cousin's wife has nothing to do with it as long as only your cousin income is being used to sponsor you. If you are going to use your cousin's wife as well, she would need to file another I-864A for you.

I would suggest reading the I-864 and I-864A instructions clearly a couple of times and marking out your situation points. Also reading the VJ guides on I-864 and I-864A, according to your situation. For example in I-864 instructions when you are reading what if i cannot meet the income requirements:

Point 1 - Income from any relatives or dependents listed on your most recent tax returns..... (Applies to you NO)

Point 2 - Income from intending immigrant .... (Applies to you NO)

Point 3 - The value of your assets .... (Applies to you NO)

Point 4 - A joint co-sponsor.... (Applies to you YES)

So cross out the stuff that doesn't apply to you and use the stuff that applies to you. Then read the forms and guides for only the stuff that applies to you. I am sure everything would clear up. And on top of that lot of experienced VJers are here to help you as well.
