I am a US citizen, and my fiance is a South African citizen. He's currently working on a island as a dive instructor. Our plan is to get married on a island sometime in January. I have been doing research on the different visas, and i've come to a conclusion that the CR1 is probably the best one for our situation. The waiting period was 6 - 8 months, so I was told. But I have been reading it could take longer than a year. Is there anyway he could come any sooner while everything is being processed? Any suggestions? Thank you soooooo much, this is starting to become very overwhelming. Also, i'm pretty sure we're going to end up paying for an attorney.

Cr1 its case to case BASIS :-) some case it took 6-8 months some are 1yr

In my opinion, Attorney can cause delayed ur papers. U can do it by urself. Just follow the instructions.

Attorney cost a lot.. but its up to you..

July 29, 2013 - Approved NOA2 ( 82 working days)

July 30, 2013 - USCIS shipped my documents to NVC

Aug 5, 2013 - Arrived at NVC Building

Aug 13, 2013 - Got the NVC case # via PHONE

Aug 14, 2013 - Got the Invoice # via PHONE

Aug 15, 2013 - Send my DS-3032 via Email

Aug 16, 2013 - AOS Pay

Sheila and Todd are very right the lawyer, they take LOTS of time and they might delay the case and they want lots of MONEY and they take their sweet little time doing it. Are you and him engaged? If so, do the K-1 visa fiance it takes like 4-6 months. Its faster but does cost more when he gets in the states for AOS.

Thank you both for the quick reply. Your right about the lawyers being pricey. I found a local one, and she is asking $1500 to do the filing. But with this site, i'm sure we'll be able to do it on our own.

I looked at the K-1 and we both discussed that path. The only concern I have, is the waiting period for when he will be able to start working :star: I'm sure he'll lose his mind waiting around till he's able to. And, the extra income sure would help me. I know this is a stupid question, but what is the AOS?

If the k-1 is faster, I don't mind paying the extra cash. I hate being so far apart from him. And besides, i'm paying too much money flying back and forth to see him.

AOS means Adjustment of status, it costs like $1080 or something like that so he can come a legal resident.

I would go for the K-1 personally

The K-1 will get him here quicker but he will not be able to work for like 90 days... The CR1 will take longer and cost less, but you will be apart... He must wait outside the US for the CR1 visa, he cannot wait here in the US with you (which would defeat the purpose anyway since he would not be able to work while waiting with you...)

You were correct in your first post. CR-1 is the best for you. Start working on it now. It's a ways away but check out Ling Che's NVC shortcuts and have ALL documents ready to send in. You can speed up the process considerably. No need a lawyer if you have time to do some research.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I totally agree with Shiela and Todd about having an attorney, do it by yourself.

Go for CR-1 instead of K-3.
