I wish you good luck Alla, yours does seem to be a very complicated case. One bit of advice I can give you, maybe take the time to fill in your timeline in your signature in your profile here on VJ (If your not sure how to do this I can write to you how) VJ members are very knowledgeable on immigration law and if you write your story through a timeline setup in your signature it's much easier to help you and let you know if and how you have any chance of staying here... some cases are however far out of the scope of what VJ'ers can help you with, so it's then best to consult a Good attorney, finding one in a newspaper ad is not always the right place to find a good attorney.

My attorney said I am not in removal. I have never received anything in the mail regarding removal from USCIS and she either.

Alla, use google to find out about EOIR or immigration court. They have a toll free number. The number can be used to find out if you have a master hearing or not. If your current marriage is true, I dont see any reason why your new AOS will not be approved. The past denials maybe of concern to the IO, but he will have to approve if the relationship is legit.

3600rs, It said I'm not in the system. I guess I'm fine. My friend also says that I should relax. But it is hard because so many people scare with their stories. Thanks again for your answer.

hey... im new to this web and i ask my self why i didnt join here long time ago.

its look like one big family here that shere the same feelings and have help all the time from each other.

my vava case is pending from jun 2008 and i dont see the end. i send RFE in nov 2009 and didnt recive anything yet. what i need to do???

Dear Alla,

The most important thing is you have someone who loves you and supports you now!!!!!!!!!! Obviously you gotta get your divorce decree before you get married again. Once you get married your husband will be your new sponsor and I think you won't have any problem filing your AOS because the previous cases are already closed; like you said your marriage is REAL and both of you could prove it, so I really don't think it would be a problem. BUT MY ONLY CONCERN IS ------- > Have you been notified that you are in proceedings now because your I-360 was denied ? Because if you have a notice of appeal in your way, not even getting married again your AOS will be approved. if so, I would definitely hire a lawyer.

Please find out if you have been called in a hearing after your denial since you've been out of status all this time. It's better to know your options before going ahead with any further step!!!!
