hello!! my interview was on oct 7 , they ask to my husband for his first divorce, we didnt have it!!

On october 14 i received the letter denied my I 130!! i could do the eoir 29__ ,, help because all lawyers said that i have to do alll over

You made a misrepresentation on the original application. You are not going to get the waiver. If all the lawyers that you have consulted with are telling you that you have to start over, then that is the obvious thing to do. You made a mistake. You know what you have to do. You cannot fix what cannot be fixed. Going to the interview would be a mistake in my opinion because your husband will have to explain the "piece of paper." That is not going to look good. It's best for you to cancel the interview and start over.

There are multiple people with problems posting in this thread. The one you responded to hasn't said anything, in this thread, about misrepresentation, it's another poster who did.

well , i wanna know if somebody pass through this, i have been talking wit three lawyers they said they will denied again my appeal but for that paper all over again..

Do you mean that your husband doesn't have a divorce decree?

Is he divorced?

If he is, he should be able to get a copy of the decree.

So you went to the interview and didn't have your husband's divorce decree and now your visa has been denied? Is that what you mean?

Was it outright denied or were you asked to provide the divorce certificate? If it's still at the embassy level, maybe the USC can request a second interview and provide the required evidence? Otherwise, you might have to file again. If it was denied then there may be no other choice.
