Bringing my Mom to the States!! Please Help!

My MIL came from Egypt...was approved thru the US embassy and it stated on her application to come visit her grandchildren and help out her son and DIL out with their new babies. She was approved for a 5 yr visa and is currently planning her 2nd trip to see us and HELP out...(we also submitted the same line on the applications w/ his sister and younger brother and nephew...all were approved for 5 yr visas) :star:

Moe never stated she was coming for baby sitting services...They have childcare already for their kids and they would like to have her come see her grandbabies and as many Mom's do...she will help out around the house.

Moe...call me or have Tiff call...I will show you what we sent my MIL to submit w/ her application at the day of interview. (F) I can't wait till she's here! I'm coming for some of her cooking!! :dance:

You absolutely cannot be serious. You are telling people that they are not allowed to have their foreign relatives and inlaws come over and visit their grandchildren and other young relatives because that is considered work????? I mean, G-d forbid when grandma comes over the baby poops in its diaper and she changed it (the HORRORZZZZZ) while the mother fed the other twin. ZOMG call the feds!

Also we had better make sure the gov't knows that they have been granting visas for this reason all erroneously because people keep saying it's to visit and help out with their grandchildren and stuff which is completely crazy.. everyone knows you should just totally not want to ever see them until they are completely self-reliant and possibly have a job at a fortune 500 company.

They are not hiring a nanny. This is the grandmother.

this issue is specifically covered in many posts and on the USCIS website.

taking care of your children so that you can both work is "working", whether she gets paid or not.

It appears that employment in this case is defined by regularity. IE M-F babysitting.

This is from the definition section of CFR 274.

(h) The term employment means any service or labor performed by an employee for an employer within the United States, including service or labor performed on a vessel or aircraft that has arrived in the United States and has been inspected, or otherwise included within the provisions of the Anti-Reflagging Act codified at 46 U.S.C. 8704, but not including duties performed by nonimmigrant crewmen defined in sections 101 (a)(10) and (a)(15)(D) of the Act. However, employment does not include casual employment by individuals who provide domestic service in a private home that is sporadic, irregular or intermittent
