Hello everyone I was hoping that maybe someone can help me with my question. My fiance ( at that time) and I came to the USa on a k-1 visa. We were married within a week upon arrival into the USA. Her I-94 expired back on june 6th and her K-1 visa in her passport expires on the 8th of August. I have not filed for her adjustment of status yet because of financial issues but i seem to have worked them out. I guess what I need to know is does she have to have all her papers submitted before the visa expires in her passport? Even though I married once i arrived with her here in the states? She seems to think that if i do not submit the paperwork by the 8th of August wich is the expiration onher passport she will have to leave. Is this true? I was not sure if there was a timeline since we married within the 90 day period. I appreciate any help you can assist me with.

well you fulfilled your visa requirments. You can fill out your AOS paperwork and send it it. If her K-1 expires before you file, it is not the end of the world. Just make sure she does not leave the country without the proper visas or permits like advance parole.

you will be ok and they will forgive you if you dont file if you go past the visa expire.

I was like that I dont think I did not file till a month after my wife k-1 expired.

Yesterday she received her green card.

I suggest that you file for ead, advance parole also at the same time.

The date that her visa expires is not relevant. (It's a one-entry visa, and she's made her entry and married.)

It is desireable, but not essential, for her to apply for adjustment of status before her I-94 expires.

Not a problem at all. Tell her NOT to worry about the expiration of her Visa on her passport. We filed for AOS almost 40 days after my husband's Visa expired. Just try to file as soon as you can. Good luck. Cris

:help: When we submit the paperwork for the AOS, do we need to make an appointment or will the USCIS Service Center issue us an appointment date? How does the next stage work after we file for AOS? :help:

The I-9 determines your authorized length of stay (permission to remain in the US), not the Visa which is a permit to apply for entry (although does no guarantee entry).

A k1 is issued with 6 months validity, toward a single entry into the US...

The I-9 likewise has a 6 months validity starting at day of entry to the US;

So, I'm a little confused how the visa can expire after the I-9 ????

The I-94 is valid for 90 days from the date of entry.... The K1 is only valid until you use it to enter and is good for 1 entry only after that it is done.... Dont know where you got I-9 from as that is a form employers use to verify your employment authority.....

Yes, I forgot the "4".. I meant I-94.

Still doesn't answer how the visa could expiration date could be after the I-94 date, as stated in the OP...
