oh my motor head i read all info about all kinds of i864,i will tell you what i understood and i need you guys to tell me if iam correct or mistaken about it: page 7 i864 there is an info(23. Current Individual Annual Income.) pls read it,so this means that if i have an adequate income in past months could it be added to my 2008? i mean will they judge the matter on yr 2008? even if my income is high in 2009 enhanced by pay stubs and employment letter? let it be known that the income in 2008 is lower about 1500 usd than what is required,i had some circumstances which made me get low in 2008 and i will include it with certified docs in my aos package.

Salaam.....I'm not sure if they will require you to have a co-sponser since you didn't make the income requirements in 2008. Although, I would call the NVC and ask them. If you can show that this year you would meet the requirements, perhaps they will allow for that. I would just call them and see what they say. Either way, just make sure to send ALL information that will help....paystubs, last years taxes, a letter from your employers. InshaAllah, it'll all work as it should.

P.S. I also wanted to add that, you may want to use the I-864EZ if you are not using any assets for income requirements. If you are then you must use the I-864, otherwise the I-864EZ is much simplier.

You may want to include a joint sponsor if you have one. Our situation is a lot like yours as I was $1,500 short of 125% of the poverty line. We made the mistake of assuming overtime would be sufficient. I had a letter from my employer that stated I was guaranteed enough OT to make the 125% of the poverty line, the NVC approved it, but when my husband got to the embassy, the CO requested we have a joint sponsor. I'm not sure if uou are working at the same place you were in 2008, but if you're making more money now, you might be okay. Unfortunately, just because the NVC approves your I-864, doesn't mean the embassy will and ultimately, it is up to them. Good luck!

yes you are right i keep this point in my mind,as i will be ready with all the required docs for interview stage,but i want to shorten the time of nvc so i will send my i485 this week,and prepare the joint sponsor upon interview.inshallah
