False RFE?? need your opinion

Has anyone gotten a false RFE message in the AVR right before your case complete?

I sent my AOS package and it was received first.

About 2 weeks later, on Oct 7, they sent me a false RFE email for the IV package, and I sent the IV package on Oct 10 with the checklist and sent it to the "DR" section of NVC, as stated on the checklist instructions.

October 15 the AVR said my IV package was received, and now today the message said on October 22, the package was reviewed and found missing documents.

I'm 100% sure I sent everything required (originals & photocopies of originals) for both AOS & IV packages (and kept a copy of each package for us). I can't imagine what could be missing.

I'm wondering if sending the AOS package to the "CMR" dept., then having to send the IV package the "DM" dept. of NVC could possibly cause a false RFE, since each package is in a different department.

I appreciate any feedback......thanks.

Oh a second post, I responded on the CR-1 forum. Although, did the AVR say specifically that your IV package was received? Usually it just says "your package" was received. Anyhow, if you are sure you sent everything, it's probably a false RFE. We had four false via AVR/ Two weeks of hell waiting for case complete. Just call Monday and speak to an operator. They can let ya know if it's false or not.

Thanks again, I wanted to post both places just in case................no, the message didn't say specifically that the IV package was reviewed/missing documents on Oct 22, but I sent it on Oct 10, and then Oct 15 the message said documents were received, so I assume they are talking about the IV package.

Insha'allah I'll find out for sure on Monday........have a good week ahead, salam :star:

they could've goofed up.....i had a similar scenario happen to me, when i sent my stuff in. i put my hubby's passport pics in a small envelope and stuffed it in with the paperwork i needed to send. i got a letter from NVC and one of the items stated that i needed to send in the pics....i was pissed off. thankfully i had like 10 pics with me so i just resent them in, but it does happen....hopefully you'll have copies of everything already so you can just go ahead and resend it all....what can you do...it's the high and mighty NVC.

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

thanks for the support......yes i did send originals and an exact duplicate package with color photocopies to them (and a copy for ourselves). I still can't imagine what they don't have, since I sent originals with english translations and exact photocopies ..............

Ahmed also took a ton of passport pics (I sent 2 with the IV package).......so we're covered.

I'll call first thing monday and see what's up with them..........

have a good week :star:

Just some more info on the NVC automated message........

on Oct 15, it said "the NVC has received the checklist letter response and is reviewing...." that was my IV package. that I sent Oct 10.

today the 22nd, the message said "the NVC has reviewed documents and found missing/incomplete......., and has sent a LETTER (not a CHECKLIST LETTER), on Oct 22........"

I'm wondering if there is a difference between them saying they sent just a LETTER, and not a CHECKLIST LETTER?

ok i know im obessing now, but i have until monday 5am to drive myself crazy. any feedback is appreciated for my sanity :star:

my husband will also appreciate any help saving my sanity :P

Stop obsessing and call on Monday... It still sounds like a false rfe to me and I would hate you bustin ur britches to send something they dont need... Cant do anything till Monday and nobody here can accuratly know if it is a false rfe or real one, only NVC on Monday can tell you that... Dont' worry until they give you reason to... I dont think USCIS lost your stuff... But stressing about something you can do noghing about at this moment will bring you nothing but lack of sleep and indegistion... So enjoy the rest of the weekend and call on Monday

I just called NVC, it seems that my husband's military certificate needs to be from the Dept of WAR, not the Dept of DEFENSE (the one he was issued)

Called him now, said no problem he can get it, even though he works in Qatar...........so that's a releif, just planning to add about 3 more weeks between him sending it to me and case complete...............hopefully we'll still get at least a december interview, Qatar is small and not a busy embassy, hopefully.
