Link describing the authority of CBP officers and the section of the INA from wherein that authority is derived.

I should like to add that I do not believe an entrant without the envelope would be given an expedited removal. THAT would be pretty hard-nosed of the inspecting officer. I would presume the alien would be given the opportunity to withdraw their request to enter the country (as explained in the body of this link). The grant of authority though to deny the entry still falls under this section of the INA.

Expedited removal is the process by which a non-U.S. citizen can be denied entry and physically removed from a U.S. Port of Entry (“POE”) upon seeking admission to the United States. Orders of expedited removal are issued by U.S. Customs and Border Protection (“CBP”) officials at a POE. The expedited removal process can only be used in certain situations when CBP officers have determined that an individual is inadmissible for one, or a combination of, the following reasons:

* Fraud or misrepresentation [iNA Section 212(a)(6)©(i)];

* Falsely claiming U.S. citizenship [iNA Section 212(a)(6)©(ii)];

* An intending immigrant who is not in possession of a valid unexpired immigrant visa or other suitable entry document [iNA Section 212(a)(7)(A)(i)(I)];

* A nonimmigrant who is not in possession of a passport valid for a minimum of six (6) months from the date of the expiration of the initial period of stay [iNA Section 212(a)(7)(A)(i)(II)(i)]; or

* A nonimmigrant who is not in possession of a valid nonimmigrant visa or border crossing card at the time of application for admission [iNA Section 212(a)(7)(A)(i)(II)(ii)].

The brown envelope is not just for AOS. It constitutes an essential part of the visa. A common misconception is that the visa consists of the sticker (actually a "foil" in DOS parlance) affixed on the visa page of the passport. Not so. A visa is whatever DOS says it is. And in the case of immigrant visas (or a "quasi-immigrant" visa like the K-1), the brown envelope constitutes part of the visa.

Don't believe me? If you have occasion to see one of the brown envelopes, you'll see that it bears the legend "THIS IS YOUR VISA."

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
