Filing for an EAD before AOS

I know this is off-forum topic, and I already posted this on the correct forum, but has anyone ever tried to file for an EAD before AOS?

Or file for an EAD after AOS?

I didnt really get a lot of answers from the other forum

I have a job offer for late January and I have to decide whether to accept or decline the offer depending on how fast I get my EAD. However, since it is going to be the holidays in two months, I doubt that filing an EAD in the AOS packet will make my application come through on time.

Any thoughts?

Oh yeah just a thought, what happens when I finish my K1? Does that mean I cant talk in the Canadian forum? :crying:

Removal of Conditions:

GC Expiration: March 11, 2012

Documents sent: December 13, 2011

NOA-1 received: December 15, 2011

Check cashed: Red said yes when asked

Biometrics: January 25, 2012

Letter approving 10-year GC: September 7, 2012

Production of 10-year GC: September 15, 2012

if you file for EAD before AOS it will cost you extra for the EAD instead of 1,010$ for all of it together. But yes you can file seperately.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Maybe maybe not, it really depends on your USCIS center timelines for the processing! which all of them are different. I believe you can check them on the USCIS website some how tho.

Sorry double post but I found this link, don't know if you have seen it yet but it does explain a little bit about what the employer needs to do. ( I know you said you had a job offer already this might be of some use? not sure :star: )

I doubt it would be any faster. There would still be a 90 day window to get it.

I haven't checked the AOS threads lately, but EAD with the AOS was only taking about 2 months when I filed back at the end of June.

Removing Conditions

Sent package to VSC - 8/12/11

NOA1 - 8/16/11

Biometrics - 9/14/11

If you file for EAD before your AOS and it gets approved (no reason why it wouldn't) it would:

  • Cost you the additional $300+
  • Be valid for only the duration of your I-94 (90 days in other words, minus the time it took to get approved)
Short story is, it's not worth it (not to an overwhelming majority of folks). Can not be e-filed (neither can the EAD you'd apply for along with your AOS). Once you do file for AOS (and EAD & AP) you'd have to pay the $1010 fee. Takes 30-90 days to get approved.
