Hi all,

My husband and I are filing I-751 soon and preparing the packet. I have looked at a lot of people's postings that they include both 2007 and 2008 tax return records. My husband and I got married in July 2007 and I wasn't permitted to work until November 2007. So obviously we didn't file any taxes together for 2007. We did file our taxes jointly for 2008 and have already obtained a transcript from IRS.

Is not providing tax return record for 2007 going to be an issue for ROC?

Tax returns will only be one of the main evidences... You should be fine if you will include more strong and primary evidences like bank statements, life insurance showing each other's name as beneficiary, loans, etc...

I believe my husband file his taxes for 2007 (married filing separately) claiming me as a dependent as I wasn't working at the time. Should I request that record from IRS also?

Here is a list of documents we have prepared so far.

Copies of passport and green card

Two sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.

A transcript of our 2008 joint US tax return.

Copies of joint leases of places that we have resided

Bank letters verifying our joint checking, saving accounts and business account.

Copies of bank statements of our saving account

Copies of bank statements of our checking account

Copies of bank statements of our business account for a business that we started in September 2009

Copies of visa cards showing joint accounts

Copies of various car insurance notices showing we are jointly insured

Copy of our marriage certificate

Photos of us traveling and at home

Copy of phone bill showing our family talk plan

We also work together. Should I include that in the packet?

Some people will tell you "the more, the better" while others will say it complicates the case even more. From the looks of it, seems like you're set to go. If it's not incovenient to get the 2007 tax records that will show your name as the dependent, might as well include it.
