well i thought i was done with my paperwork, but now i'm worried about my affidavit of support.

i am disabled and don't have any income...

that is, i have a bank account with money in it. and my parents (co-sponsors) are helping me out while i wait for ssi disability to kick in, but i don't have a regular job at the moment.

do i need to disclose anything on my affidavit?

05.17.10 - I-485/I-765 mailed

05.25.10 - NoA

06.25.10 - biometrics appt

07.02.10 - emailed that our case is moved to CSC!

07.14.10 - touched

07.21.10 - touched

08.03.10 - approved for EAD

08.05.10 - uscis mailed out EAD

08.09.10 - EAD received!

01.05.11 - a ###### RFE over 6 ###### months after the fact

02.01.11 - touched

02.14.11 - APPROVED (finally)!

02.25.11 - received green card in the mail

DONE WITH USCIS FOR 2 YEARS!

I looked it up and it says that you and the cosponsor have to fill it out, if you don't have an income you just put 0 or NIL.

As long as you have a cosponsor I think you'll be fine no?

Someone else can hopefully pipe in here.

I'm not following you, if you have filled out the form you don't need to disclose anything else. What, specifically, is your concern?

I'm not following you, if you have filled out the form you don't need to disclose anything else. What, specifically, is your concern?

well i put 0 for all forms of income, but i do have a bit of money squirreled away in my bank account. nothing terribly significant, but i don't want it to bite me in the ####- you know what i'm saying? like, could i get in trouble for having a couple of thousand in the bank and not disclosing that?

im not totally sure on this but we didnt disclose our bank information for the k-1 or the aos and it didnt do anything.. I think its only if you are going to use it to try and sponcer your SO by yourself. Im not sure they really care what you have in the account but its more what you are making from the job that is important to them and you dont work right now so I wouldnt worry about it!

I double checked this and unless you are planning to use the money to sponsor either by yourself or with a co-sponsor, you are under no obligation to disclose it.

Hi Bogartnoir,

Sorry to hear about your situation, and I hope that your disability income comes soon. In the meantime, it's good that you have your parents as co-sponsors to help you and your significant other with the immigration case. Lol..likewise, I had to use a co-sponsor for my immigration case too, so I can relate to you about the co-sponsor thing there.

In answer to your question:

-Overall, the USCIS does not care how about the exact amount of income you have (or lack of income). Income-wise, the only thing they care about is whether or not the income is above the "poverty level" for the affidavit of support. So whatever you have in your bank account and/or other assets have to be equal and/or above this level, or otherwise, they won't take that into consideration. Lol..for example, you can have 2 cents in your bank account, and they wouldn't care, as that doesn't meet the amount required to be above poverty level.

-The only thing you would have to disclose is your lack of income, and explaination as to why this is such. For example, a letter stating that you are waiting for disability and cannot work in the meantime and why you will need co-sponsors for your case.

-Despite your lack of income, you still have to fill out an affidavit of support, and put your work income as "0". But if specifically asked about your bank accounts, and/or other assets, during the interview, then you would have to disclose about this and not lie about it to an immigration officer.

-Your co-sponsors need to fill out one of these affidavit of support forms too, and fill out their financial information and particulars, that is above the poverty level, to be considered as co-sponsors in your immigration case.

thank you so much for the thoughtful and informative answer! that makes me feel a bit better. i will do what you suggested and write out a letter explaining my situation. hopefully that, along with my co-sponsors income, will make this an easy interview for us.
