BRAZIL K1 Process/Experience, Feedback, Concerns, Advise

As posted, go to the free clinic BUT have all the necessary vaccines.. When you guys are ready to process your AOS, you will need to visit another doctor [CS] in the states to complete your I-693, but the CS will not sign the form unless you have a full medical record according to the US Department of health, this means a full vaccination record, not only the requirements for the US Embassy in Brazil.. I'M TALKING FOR EXPERIENCE. My wife's record was complete as required in brazil, and we send our AOS with the necessary proof.. we got a REF during our AOS due to the incomplete medical record..

When we visited the Civil Surgeon [CS], he explained how the process for the AOS works and why they required her Vaccination Chart to be completed. Besides that, we needed to do additional TB and Blood work as her reports where in Portuguese and not in english. Thank God didn't cost us much..

Bottom Line, get all your shots required by the US Embassy and the US department of Health.. get them there is cheaper and/or free

Just go to the free clinic with the list of vaccinations he needs (which will probably just be MMR x2, TDP, and possibly varicella if he's not had chicken pox). He will need to return in about a month to finish the MMR series.

Once he's had the vaccinations and you've got the RDJ number, make the appointment in SP whenever. He lives there (as I recall from reading your profile), and it's way easier to have the medical completely done before the interview than do what we're doing (the day before).

When you say complete, do you mean more than just MMR (x2), TDP, and Varicella? (I say x2 for the MMR because while it appears that only one is required for immigration, I know for my graduate studies, I had to have a second MMR vaccination. I also had to get a ton of other vaccinations - Hep A/B, typhoid, meningococcal - when I started my thesis research, due to my lab's affiliation with the hospital, but they're really not standard.) L took a second MMR and TDP and wasn't planning on taking Varicella, as he had chicken pox as a child.

If you have all your vaccines, doctor, in Brazil, will provide you with form DS-3025 [in English]. In the US, you will visit a CS and he/she will transfer your records to I-693 so you can present your AOS submission.. if anything is missing [based on USHD], then you will be required to complete the missing vaccines.. even if the DS3025 says complete [per USCIS Standards]

The CIS standards for both the K1 and AOS are based off the CDC standards. Unless you've got an incomplete series (MMR has 2 and Varicella has 2 *if* it's not contraindicated), or you've hit 50 in the time between the K1 medical and the AOS, you shouldn't need additional shots. If your wife had had MMRx2, Varicellax2 (or had chicken pox), and TDP, she shouldn't've needed any more vaccinations. I'm curious what they vaccination they told her she needed. (I'm guessing that it was probably completing the HPV -- the DoS was allowing women to come before the HPV series was complete and requiring it to be finished before AOS, but HPV's no longer a required vaccination.)

4460552224_311aff84c3.jpg

Better highlighting of the table from the 2009 CDC instructions for vaccinations for immigrants. Most of our fiancé(e)s just need the MMRx2 and TDP, and Varicella if they haven't had chicken pox, and they'll be good for the K1 and AOS.

Your DS 3025 will have the schedule of vaccinations applied including dates, of course, age appropriate. If you have all your records in order including MMRs, Varicella, TDPs etc, etc prior visiting your doctor [in brazil] or the CS in the states, either one cannot force you to apply second dozes..

Fist Question [Foreign Country].. what are you required prior K1 interview..

Second Question [in the US]... What are you required by the USDH, in order to complete your I-693.

You will find CS looking to make money and charge you outrages fees, you will need to find the right person who is not compromising ethic for finances.. present all your records and let them complete the form.. If you records are in order, your vaccination chart is completed here and abroad, then your DS 3025 and all Health Vaccination Chart from your home country will show proof the CS to properly complete and sign your I 693..

Hey,

Anyone have an interview in Rio for the K1 lately?

Mine is May 4, 2010... anxiously waiting.

Brad

Hi, wishing you the best on the upcoming interview.. We are sure all will be done fast and when you less expected, the airport waiting will feel longer than the K1..

If you look at the Brazilian Portal, you will see 5 interviews done from May 23 - April 1st.. Maybe, you want to touch bases with them to hear/feel some feedback. I been following up this site and some other community and the negative feedback is less and less.. If you have all your documents in order, you will have no problems.. make sure you have everything ready, exams, police reports, affidavit of support, proper picture showing ears, etc, etc, etc..

Best Regards,

Our interview is Thursday, I'll be happy to tell you about it afterwards :)

We're all set up, I think. I've got cosponsorship ####### set up (if it's needed - I don't think it will be, but since I lack a 9-5/5 days a week/52 wks a year kind of job, I figured it couldn't hurt), along with my I134/07/08/09 taxes (to demonstrate that while atypical, my income has been steady this way for years). L's got the various forms he needs (birth certificate, etc), as well as his medical all scheduled and confirmed that it'll be done by 3pm Wednesday.

Incidentally, the list of documents posted before is outdated now - they updated it in November. It's mostly the same, but they added two more things - court cases and previous USCIS/DHS proceedings.

STOP! Failure to present valid passport, pictures, Citibank fee and electronically filled DS-156 form, at the time of your interview will result in an appointment rescheduling to a later date. This procedure may take, in some categories up to two or three months.

IMPORTANT NOTICE FOR FIANCÉE K1 VISA APPLICANTS:

On the day of your fiancée visa (K1/K2) interview please provide the list of documents below completely and all the forms listed carefully filled out.

Please provide original or notarized copies of the documents listed below.

1. Two frontal photograph showing both ears (5 X 5cm or 5 X 7cm);

2. Valid passport (at least eight months validity remaining);

3. Visa fee previously paid at Citibank;

4. Application for Immigrant Visa‐form DS 230‐I (duly completed and signed);

5. Two DS‐156 Forms (electronically filled out with bar code and signed);

6. DS‐157 Form (for those over 16yrs);

7. Sworn statement (for fiancées only);

8. Birth Certificate (even if previously married);

9. Termination of previous marriages (if applicable) with a simple copy;

10. Police Certificate(s) – In Brazil you need two: from the Federal Police and the State Police (Secretaria de Segurança Pública) with a simple copy;

11. Financial Support – E.g.: Affidavit of Support (I‐134 Form) including supporting documents. (see form instructions for attachments);

12. Sealed envelope of Medical Examination Report;

13. Complete Court Records, judicial situation, including processes in Brazil and in the U.S. (if applicable) with a simple copy;

14. USCIS/DHS processes/records (e.g. deportation proceedings, voluntarily removal, change of visa category processes, petitions or hearings before immigration judges, asylum papers, etc.) with a simple copy.

Hey guys... FYI... With regards to the new DS-160 Form... I actually got a reply from the US Embassy in Brazil to an e-mail I sent asking if this new form will be needed for K1 applicants.

The new form DOES NOT apply to K1 applicants... Please see attached thread... DS-160?

Dec. 28, 2009... NOA 1

Dec. 31, 2009... Touched

May 12, 2010... Nice guy at the USCIS mercifully sent a Service Request to the VSC to inquire about our petition

May 27, 2010... Received an e-mail stating that the VSC received the Service Request. Unfortunately, the e-mail also states that the processing time for service requests is 3 MONTHS!!

June 28, 2010... Heard from my senator that the USCIS is going to send me a RFE on July 1 asking for a certified copy of my birth certificate. Why do they have to wait until July 1 to ask for this??

July 13, 2010... Received an e-mail from the VSC explaining the delay in processing our petition. Apparently, the USCIS had put on hold all petitions from US citizens born with Puerto Rican birth certificates (like me). On July 1, USCIS headquarters finally gave clearance for these petitions to be processed.

July 26, 2010... Touch

July 27, 2010... Received text message and e-mail stating that our petition was approved on July 26!! We finally received our NOA 2!!

July 31, 2010... NVC received our approved petition

August 2, 2010... Received paper copy of our NOA2

August 4, 2010... Received letter from NVC confirming receipt of our approved petition

August 13, 2010... US embassy in Brazil received the approved petition

August 23, 2010... Missuzu received Packet 3/4

October 19, 2010... Interview... VISA APPROVED!!!

November 4, 2010... Missuzu received her passport with visa

December 27, 2010... POE... Houston, Texas

December 28, 2010... We got married!

This thread is 15 pages long, so forgive me if this has been asked and I didn't see...

My question is... What does the US Embassy in Brazil require as the documentation to be included with Form I-134? The document on their webpage titled "Instructions for K1 Visa Applicants" says:

The sponsor must attach proof of his/her income such as: Copy of last U.S. Federal Income Tax (form 1040), proof of current employment, job offer, pay-slip, etc.

But the "official" instructions for Form I-134 says:

The sponsor must submit, in duplicate, evidence of income and resources, as appropriate.

A. Statement from an officer of the bank or other financial institution in which you have deposits giving the following details regarding your account: 1) Date account opened 2) Total amount deposited for the past year 3) Present balance

B. Statement of your employer on business stationery, showing: 1) Date and nature of employment 2) Salary paid 3) Whether position is temporary or permanent

C. If self-employed: Copy of last income tax return filed, or report of commercial rating concern

D. List containing serial numbers and denominations of bonds and name of record owner(s).

Obviously, it is a lot easier to provide copies of my tax returns, pay slips, bank statements, etc. as opposed to "signed statements" from my employer and banks...

Which is correct?

Thanks in advance

Yes it is less complicated. I have read in the past, letter from your employer is necessary when your income is below poverty line.. but when I process my petition, my attorney included the employer letter as part of the evidence for the Affidavit of Support I-134.

I included:

* Copy of the last income tax filed with W-2 or 1099 Forms [if self-employed]

* Statement from an office from the bank where you have deposits, identifying the following: Date account open, Total Amount deposited for the past year, Present Balance. [Most banks have a pre-formatted letter]. I have Citibank and they mail a copy directly to the Embassy in Rio and a copy for my records.

* Employment Verification Letter with the following information: Date and nature of employment, Salary Paid, Whether the position is temporary or permanent.

* List of containing serial number and denominations of bonds and named of record owner

Hope this help

Is best for you to provide with additioanl evidance to have your petition referred for lack of evidence or missing information

I will suggest, provide them with all I mentioned above..

Pretty much the consulate just wants to see some verification of the claims you make on the I-134. If you say you make $20k/yr, they want to see your taxes/w2's that you make that, and a recent pay stub or a letter showing you're still making that. If you say you're a student, but wholly own a $60k townhouse, they want to see the assessment and some sort of validation from the bank or dealer that there's nothing owed on it, and so forth.

IMO, it's kind of like the 'proof of having met' - the threshold is pretty low, but nobody wants to get a RFE for not submitting enough evidence, so they overshoot and advise the same.

ETA: like our evidence of meeting from our petition, we're somewhat lowballing - I'm bringing my taxes/w2s from 08 and 09 and tax transcripts from 07, one not terribly impressive pay stub (as I'm on academic leave until May), and my job offer letters. Maybe I should bring my diplomas and say "if I wasn't in grad school, I'd make twice what i do!" :lol:
