She doesn't have a SSN - thus is unable to get a State ID as that is generally required. She needs to have photo ID to obtain her Canadian passport along with her Canadian birth certificate. Her only photo ID is an expired Canadian health card - and Passport Canada has said that they may not accept that. The Consulate has nothing to do with issuing passports. They can arrange for an emergency travel document/passport to be issued for the purposes of returning back to Canada if they believe she is indeed a Canadian citizen where she would then apply for her full passport - but that emergency travel document/ passport would still be issued from Passport Canada and would be used only to return to Canada. If she returns to Canada - where she could also apply in person for her passport - she will immediately incur a 10 year ban on re-entering the US, and would require a hardship waiver before she would be allowed to return. She and her husband have been trying to raise the money for the AOS as they married on a whim and had no idea of the immigration process involved. They realize now that the lack of documentation is a real liability and a catch 22 situation - she needs to have valid photo id to attend the biometrics for AOS that they will be applying for and she is trying to arrange to get a passport as that is the most likely type of photo ID she can obtain - but the process is very controlled - Canadian passports are much more difficult to obtain than US passports and require the use of guarantors and additional identification. Her concerns are legitimate - but she does need to apply for a passport and see if she can get them to accept the expired picture ID. An emergency passport/travel document is probably not going to be of any use to her in her circumstances.

She has never had a passport. That is part of the problem. Her sole identification is a Canadian birth certificate and an expired Provincial health benefits card.

I don't know. There are several types of Emergency travel documents depending upon what the circumstances are and there are several types of travel documents depending on what the circumstances are.

So assuming that Kitty tries and fails to get a passport, they would at least give her this to return to Canada? Do you think the officer at the door to the biometrics office would accept this?

hmmm...difficult to tell.

If there is no picture at all...I don't think they would accept it. Again-it is just an assumption.

What if somebody who has a bio appointment around the corner asks directly to get an answer for Kittyfang?Anybody?

I am sorry. I don't mean to be impolite and I really want to help. But this is bullcrap.

We are figuring out how to cross a bridge that is not even in sight? I've been dealing with the dreaded immigration thing for a long, long, time; hence here is my advise:

1) Get money to file the I-130, I-485, I-765.

2) File for AOS. The moment you have your NOA you are legal and safe until it's been decided upon.

3) THEREAFTER go to the Canadian embassy in person. Bring your birth certificate and whatever you have plus your NOA (showing legal presence) and apply for a passport. If they don't issue a passport, they WILL, 100% give you a government-issued ID, perhaps the same they give to citizens who have zero documents and need to travel home. Don't figure out what color or size it is. Who cares?

Don't lose sleep wondering if you can cheat on biometrics, or other nonsense. There are tens of thousands of Canadians that were walking in your shoes before. Stop the drama and start figuring out how to pay for the thing. Thereafter move to step 2. Biometrics is step 4.

Just BOB-It looks like you had been out of status for a long time before you got married. Did you have any valid ID left when you filed for AOS or they were expired?Maybe your answer would help Kittyfang.

What's she going to do after she goes back to Canada with that document? Get her passport?

The only point in Kittyfang going back to Canada is to file for an immigrant visa. If she has to do that, there's no need for mucking about with ID documents as she can get her passport when she goes back.

I know that this is a very old discussion, but I figured I would let the suspense end.

I used my birth certificate with my Social Insurance Card (the old one with a signature on the back).

And received my passport a few weeks ago. :-)

Adjustment of Status

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done
