I've tried to read it all but it's just meaningless chatter. The equivalent of watching two old ladies in the hair salon, circa 1970.

Let's approach that with some system, shall we?

1) You are a Canadian citizen. You have an expired Canadian passport. You have a Canadian birth certificate at hand.

2) You are married to a US citizen. You must have applied for AOS, otherwise you would not have an biometrics appointment.

Am I right with this so far?

Okay, you are in a foreign country. Imagine you are in another foreign country, like Timbuktustan. You were mugged. You are naked. You have nothing but your wet clothes on you. You go to the next Canadian embassy and say: mutherfockers, I'm a Canadian citizen. Here's my information (name, address, etc.). Check it out, then help me, I want to go home. They WILL give you some "government-issued" ID.

For the same reason, you could apply for a Canadian passport (cost money, I know). If you applied for AOS, you are legal until that thing is decided upon. That's enough documentation for the Canadians. If they give you sh*t, ask to see the consul.

How am I doing so far with my guessing game. Tell me what I don't know.

I went to the Passport Canada website, and they have an interactive application form that you can fill and apply for a new passport. You need proof of citizenship (your birth certificate which you have thankfully, you could have left it in Canada when you came here...) and application fee etc...

I would suggest you fill it online, send your application and see what happens. Take your chances on this one.

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

No she doesnt have an expired passport, no she hasnt applied for AOS. She doesnt want to go home she wants ID to apply for AOS, to get into the biometrics building you NEED VALID ID and all she has is an expired health card picture ID over 1 year expired. And a birth certificate.

I think that sometimes it is useful to go over the "hair salon chat"....Whatever you wrote here has already been discussed. :thumbs:

Plus, there is no "expired passport involved". There is no passport at all.

Hey there

When i went to get my taken all they asked for me to show was the letter that proved that i was suppose to be there that day, and then the guy asked if i had my pasport with me i took it out and before i could hand it to him he looked away and never took it so i dont think that you have anything to worry about

That's poor advice. IF that actually happened that way it was a major slip on the part of the person letting you in. The instructions for necessary ID are very clear as previously stated.

I agree with the "apply for a passport and see what happens". I don't think you have any other options at this point and nothing to lose by doing this, that I can see.

My husband was an overstayer but still had a valid passport. Sorry I don't have more to offer.

Okay, I'll have to do this step by step.

Sorry but you need to again, go back and read things, you are still wrong on what the issue is.

She does NOT have a bio appointment she has NOT filed for AOS. She is worried about providing ID for AOS bio appointment and trying to figure it out BEFORE she files and gets the bio appointment.

She has not filed becus (a) she didnt know about the whole proccess of visa and aos (b) she and her husband are low on money.

She has an over stay of so long that she could incur a 10 year ban. It is NOT sufficient to apply for a canadian passport just by being " legal " there are required documents and rules to filing for passports.

ALL of this information is in the thread. Please read before you post advice to understand the entire situation.

Legal or illegal, with or without sufficient requirements, canadian embassy should give her a passport or some sort of identification. Embassies should help their citizens regardless. I cannot believe an issue of getting a canadian passport used up 5 pages and is the hottest thread on VJ.

Im sorry to hear about your health but your best shot in getting your passport is by going to your embassy even if distance is an issue because obviously passport canada is useless/worthless to you. I mean, what does a student loan have to do with passport application? People have loans left and right (car, house, credit cards, etc.) and still get passports.

I am sorry. I don't mean to be impolite and I really want to help. But this is bullcrap.

We are figuring out how to cross a bridge that is not even in sight? I've been dealing with the dreaded immigration thing for a long, long, time; hence here is my advise:

1) Get money to file the I-130, I-485, I-765.

2) File for AOS. The moment you have your NOA you are legal and safe until it's been decided upon.

3) THEREAFTER go to the Canadian embassy in person. Bring your birth certificate and whatever you have plus your NOA (showing legal presence) and apply for a passport. If they don't issue a passport, they WILL, 100% give you a government-issued ID, perhaps the same they give to citizens who have zero documents and need to travel home. Don't figure out what color or size it is. Who cares?

Don't lose sleep wondering if you can cheat on biometrics, or other nonsense. There are tens of thousands of Canadians that were walking in your shoes before. Stop the drama and start figuring out how to pay for the thing. Thereafter move to step 2. Biometrics is step 4.

I don't understand why you can't get a state issued ID card from the Department of Motor Vehicles.

Hell, they give them to kids in my state.

*oops well I just read my State's requirements more closely and it looks like non-immigrants can't get an ID without visa in passport*
