What a bad Valentines Day

Ok,not enough that the people my fiance is renting from (500$ for a tiny little room in a house way out) told him shortly before I came to the US for a 3 week visit that we can't stay at their house(still charged him 200$ rent though he will be there for only 4 days this month) because they dont want my 5 yaer old there,now they just told him TODAY that he's got 3 weeks to move out.

He got a black Lab around X mas and ( even though the people he"s renting from have two dogs) they made him pay a pet deposit of 500$ though THEY never made one to the original landlord.

Now we have problems paying for the Hotel we're staying at because H&R Block told us we wont get the tax return back before 8 to 15 days..............and Jim wont get paid until Friday of this week.......

Jesus Christ why do we have THIS much bad luck here latley????????????

At least I will be with him here for another week.........

But thats about the only good thing.

Gosh I really need a break!!!!!!!!!!

Paul and I met on the Bazaar on the 14th January (he joined my progressive rock forum that day)

July 3rd he flew to England to meet me

We fell in love while he drove all over the place coz I cannot read maps (we were supposed to go to Ingleton - but touched Darlington 4 times, Pierce Bridge 6 times, Scotch Corner twice and Bernard Castle twice and we never did make it to Ingleton)

It has been so long and so much has happened in between...

Arrived in Houston on October 29th 2006

Married 17th November 2006

Lost my father 8th January 2007 (all dates are a blur after this)

Conditional Green Card dated 24th October 2007

I-751 posted on 6th August 2009

Received on 7th August 2009 in VT

Natasha, have your fiance read up on the housing/rental laws in his state.

If there is a lease, they can't just change the terms....AND deposits have to be handled in a businesslike manner...technically, it should be in an escrow acct & he should know all the details of such...and if any claims are to be made on the deposit, I believe he has to be notified in writing.

Each state is different, so have him check it out....these bastards can't be allowed to just railroad him like that.

THANK you all for your replies!

Jim rented the room from a guy he"s working with.

That guy and his wife rent the house from the original landlord.So as far as I know there is no lease contract between Jim and them people nor Jim and the owner of that house.

The pet deposit they took off of him-

well I have no idea where that went but Jim will tell me tonight when he gets off work what Ben (his ####### of a co worker whom he rented the room from) had to say about giving them 500$ back to him.

The reason they now told him to move out asap is because Bens wife "just never liked" my man.

Yeah but she sure liked his money!!!!!!!

I wish I could just call them and give them a nice piece of my mind but unfortunatley Jim sees the guy at work every day and has to work on them aircraft WITH him.

Now I worry about them spreading rumors about Jim at the company......................

God help us.

Yes we are together for one more week.........It hurts so much to know that I have to leave him.

Cant really hide my sadness ,not even around Jim...............

I agree, but given the fact that you're filing in Nebraska which indicates you're living in the Midwest, I wouldn't put too much hope in the existence of rental codes. In Indiana, for example, they are local and don't think anyone would do something to change them; after all it's private property and not the business of the city council. Another problem would be the fact that he's subleasing from other people leasing, and that those people might have forgotten to tell the main landlord which makes the whole thing legally unenforceable. Try seeing of there is some organization that helps with rental disputes in your area to see if that would resolve the problem. If that doesn't work get in touch with the landlord of your fiance's sub-landlord; maybe they'll be willing to kick out the sublandlords for contract violation which would at least make you guys feel less abused.

Anyway, hope your fiance manages to get his deposit. He should try to find something less sketchy if at all possible. I know it's not easy to rent in certain areas, but it can't get much worse than what he has now.

I know it's private property, but that doesn't stop the state from governing the rights of tennants....now I can't say that I know each state's laws off the top of my head, but I'd be very suprised if there wasn't something on the books dealing with tenancy agreements. Even private landowners are governed by these laws.

Now as I said, I'm unsure of each state's specific laws, and if I'm wrong then I'm wrong....but renting out private property does not preclude you from having to follow the law.

The fact that it's a sublease situation may be an issue, and perhaps if it wasn't allowed to begin with as per the terms of the lease that the original renters signed...and if that's the case, there might be some bargaining power for Natashabrenda's boyfriend....after all, if subleasing a room out was prohibited, he could use this as leverage to get some of his money back, possibly.
