How to Cancel or Withdraw K-1 Petition?

I hate when this happens, all of us are waiting for our visa to be approved and "NOW" she decides not to follow through. Note to everyone make sure you are willing to spend the rest of your lives together BEFORE you file for a K1 visa. This is very upsetting to me. Someone elses petition could have been approved and actually want to get married.

I agree with you, we are adults and we should take reasponsabilitys fou ours decisions and behaviors, I cannt wait to see my husband again and have interview and be together

Once you people have a timeline like ours then and only then maybe you can write what you did but only out of frustration, check it out 1130 days ago today we applied and where is our visa, Montreal sitting someone's desk.

Don't ###### until you earned that right

09/20/2006 - Sent I-129F

09/22/2006 - Received at NSC
09/28/2006 - NOA-1 (1-797C date )

10/02/2006 - Cheque cashed

10/02/2006 - NOA 1 (I-797C recieved in the mail)

12/08/2006 - NOA-2 in 79 days

12/13/2006 - NOA-2 hard copy recieved

12/26/2006 - Package recieved by NVC

12/30/2006 - Received by Montreal

01/22/2007 - Received Packet 3

04/16/2007 - Returned Packet 3

08/02/2007 - Received medical documentation

08/07/2007 - Received Interview date Aug. 9th

08/09/2007 - Received I-601 and 212 (not approved yet)

02/17/2008 - I-601 approved 212 abandoned

06/2?/2009 - New medical and passport and doc sent to Mtl

07/22/2009 - Recieved request for DS-221 and notarized letter of intent

07/31/2009 - Montreal recieves thier final requested doc.

09/01/2009 - Visa approved and mail out today

I would just caution the OP to not make hasty steps here.

If you withdraw your petition and your fiancee changes her mind (again), then you'll have to start from scratch. As others have mentioned, this is an overwhelming, life changing decision, some doubt is reasonable and to be expected.

If your fiancee goes through with the interview and is even granted a visa, she still doesn't have to use it if she still doesn't want to.

Either way, we are sorry to hear about your troubles. I think many couples on here go through a stage in their relationship when it gets pretty rough as the foreign fiance(e) realizes they are about to leave behind everything they know.

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

I would just caution the OP to not make hasty steps here.

This is true - but - if the petitioner has already sent everything to the beneficiary that they need for the interview, the beneficiary could fraudulently attend the interview, obtain a visa, and even enter the US.

If it's REALLY over, I would inform the consulate.

It is scarey just before the interview. You can be terrified of doing something wrong. It is a big thing. I got so scared before mine. My husband responded by coming over to support me to show that he would be there whatever happened. I think maybe you need to reassure your other half, and say that at least if she goes for the interview she will have true freedom of choice, without fear. Otherwise she will never know. Families can be harsh and cruel prior to interview. Much pressure. In a sense she has to do the interview for herself, so she knows she has made the decision herself.

On the other side of the interview, (and prior to it once I had said how scared I was to my husband) things feel fine. Saying goodbye to family, and there is nothing left to scare me any more.

If your other half was not in some way wary of the move she would be foolish. Don't give up on her just yet.

Omg what a terrible thing to say!! Any one of us who as actually been to their fiance's home country should realize how difficult will be for them to move here, away from their families, and cultures. And any foreign fiance who is in regular touch with their American SO's should know that this is not the land of milk and honey- America isn't for everyone, and while it's terrible for the OP that this happened so close to the end of the process, it's so much better that it happened NOW and not when she stepped off the plane, or worse yet, after they began a life together. I'm sure it was a difficult and painful decision for her as well.

To the OP- I'm so sorry this happened to you. I hope things will work out for you in the long run.

karenista, I'm so sorry to hear about your story. It just feels so terrible and hurt isn't even the word to describe how it feels. Oh well.. that's life I guess. I wish you the best as well. thank you.

itzallgood, thanks for your words. It will have to be a man of solid character but now I've lost all the trust on men out there.

Nik+Heather, yes, I've waited for more than ten days now since he announced his decision. I do agree with you but with this kind of situation, I'm more worried about being forced to take responsibility for people who I don't trust and could become my legal responsibility against my wish.

As for him changing his mind again, I am certain I am not interested in overlooking this decision of his. It's caused pain and done damage not only to me but my family/relatives and it's not even worth describing to what extent. When he decided, that's exactly what I told him. I asked him to think about it after going for the interview but he refused and was adamant about just not going. I can't change his mind and honestly, now I don't want to. Thanks for your comments though.

jellyfish, thanks. It's not possible for me to go with him to the interview. At first I had offered to go but he said he would be fine and that he'd rather have time to spend with me later than for his interview. Any ways, it doesn't even matter now.

I still can't believe it.

I'm heading out to the post office to mail my withdrawal letter to the embassy now.

1. Wrote the withdrawal letter as suggested by milimelo and got it notarized.

2. Scanned the letter into a PDF file.

3. Mailed the original notarized letter to US Embassy with tracking service for delivery.

4. Sent the scanned PDF document via email to the US Embassy with the shipment tracking info. I had also requested them to send me a reply when they receive my email with attachment and they were nice enough to confirm the receipt.

The US Embassy accepted the scanned version of the letter and said they've added it to the file.
