I am guessing this might be too complicated for you --- I suggest you consult an immigration attorney. I've helped all I can.

Its very complicated however I dont have the money to afford to get an immigration attorney. I thought that is what this website was for, to get some help from other people going through the same things. I can't help if I dont understand the first time someone tells me something.

Well girl ,h ave you read the guides? I didn't know squat about this when we did DCF, and we sailed through it after reading the guides and the instructions in the forms. Husband was primary sponsor and we had a joint sponsor. Believe me, reading the guides will be a great investment of time.

Yes I have been reading much things and even trying to go to different websites. so your husband was your primary sponsor and he lived with a joint sponsor and your husband and the joint sponsor both did the I-864 even though they lived together?

Nevermind, I see in one of your other posts that he doesnt. and on thinking about it more I am not sure it would matter if he did.

A few years ago there was a couple going through Casa who had a similar problem - she, as sponsor, hadnt made enough money in the past years to even file tax returns so she didnt send in the 864 and just sent the one for her cosponsor. She got the same response and was instructed to file one with herself as the primary sponsor and then an additional one for the cosponsor, even though she had no income at all to report. I look at it this way, I work in a job in which we have files that we work on from the beginning to the end of a process, and at the end there are a number of documents which just have to be in the file, whether or not they applied exactly to the situation or not. They have to be there, period, and if one of my files ever gets reviewed or audited down the line I will have to answer for why something isnt there. Obviously they just need the document from you for their file, even though the financial responsibility is clearly on your father. I think you are going to drive yourself nuts trying to figure out all the why, and I am not trying to be short with you but quite honestly you are overthinking this and making it harder on yourself. They want it, they've asked you for it, just fill it out and get it to them. Put your household size at yourself plus kids and spoouse, and your dads as him and mom, and then make sure he makes enough to cover all of you per the poverty guidelines. Personally I dont think they are hung up on physical address. For example, if your father had sponsored long lost uncle Kracker 2 years ago and now said uncle lives in alaska, he would still be counted as Dad's dependent for purposes of the form.....

If the CO asks you for a document....then you submit it.

We would have requests for documents that we KNEW were in the file and sent with the file because we made copies of EVERYTHING that was sent. But there was no argument..... you do what they say.

If the embassy wants this document that is fine I have no problem in that but I dont know what to do about combining our incomes and our household when I am living with my joint sponsor and he is also my father. When I completed my I-864 I combined mine and my father's income and included me, my 3 kids, mom, dad, sponsoring husband but If my father doesnt do the I-864A then I cannot combine incomes or household members so therefore do I need to do a complete I-864 over again also and then what would I put for incomes and household members because I am living with my mother and father. I know when you do I-864 and I-864A you can combine incomes and you must include all people that live in the household together but when I am doing the I-864 and the I-864 you can't do that so I am not sure how to fill out this out now.

Forget about the combining incomes and the 864A. Fill out one with your income and your dad fills out one with his(marking cosponsor), send them both back in. It sounds like that will solve it

Jeni, I know Cairo isnt known for responding quickly but why dont you try calling or emailing them and just ask if they want a new one for you....maybe that will put your mind at ease.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

Good idea! It'll take a week for them to respond but it sounds like the week's break of worrying will be worth it!

I did email them and it does take them a long time to respond so I am hoping they do it quickly. Ok I am starting to understand my father and I both need to do I-864 and not combine incomes I do one and put my income and he does the other and puts his income but on the I-864 it has a place that ask you how many people are in your household size my kids and I are living there with my parents so should my father still add us to his household size and me also add mom and dad to my household size on my I-864. I am not working but going to college so truefully my dad is supporting me and my kids. I just dont know what to put for household size thanks.

I *think* you add yourself, your kids and hubby... and your dad adds his dependents(just your mom ?) and your husband.

If your dad isnt claiming your kids as dependents, I dont think he needs to on the AOS. But read the instructions carefully and it should tell you about how to calculate household size(IE- who is counted where)

I do know you both want to account for your husband in your household sizes.

On the I-864 you fill out, the size of your household is determined by the number of people you claim on your taxes....so I'm guessing its you and your children. Your dad's household size, for the purposes of the I-864 will include himself, your mom + your husband, and any other dependents. At the very minimum, your dad's household size will be 3 (dad+mom+your husband, the intending immigrant).

It won't let me edit....but your husband will be counted in the household size of both you and your joint-sponsor (your dad)....not just on your dad's household size.
