Hi,

I am from Germany and currently here on a J1 Visa. Me and my boyfriend (American) wanna get married. Do I have to return to Germany to get the K3 visa? Or can I just stay here and change my Visa status from here? And how long will it take to get the K3?

Unless you have a home stay requirement attached to your J1 visa, you can PROBABLY simply marry and stay. I say probably because it depends on whether your decision to marry and stay occured before or after your latest entry to the USA.

because if you intended to remain (ie.. be an immigrant) in the USA the last time you entered the USA as a NON immigrant... the USCIS frowns on that...

because if you intended to remain (ie.. be an immigrant) in the USA the last time you entered the USA as a NON immigrant... the USCIS frowns on that...

If I was only risking a frown, no big deal. People frown at me regularly. :thumbs: The consequence of concern is that you application to adjust status is denied and your $1,010 bucks goes down the drain, then you leave the USA and get a spouse visa before coming back a few months later. Kinda worse than a frown, don't ya think?

You can apply for Employment authorization at the same time as AOS. It takes right around three months.

Just one more thing: if I`m already in the US, how long will it take to get the K3 visa/to change my visa status from J1 to K3?

You would just be changing status to conditional permanent resident, not obtaining a K3 visa. Visas are used to enter countries. You are already IN the USA. Start by actually reading the Adjustment of Status Guide here on VJ for an overview. Count on it taking three months or more to complete AOS but you can get advance parole and work authorization in about three months. How long for adjustment depends on how busy your local USCIS office is.

Did you first check if there is a home residency requirement on your J1. This is a very important issue in your case . Find that out before doing anything else.

08/28/2008. Touched. (This case is now pending at the office to which it was transferred)
